After the phone call on Tuesday at my workplace which I was most annoyed about and in the process of reporting thew. I have now received a 14 day legal proceedings letter. Apparently unless I pay up they are going to issue a CCJ may then be enforced by a court appointed bailiff which will incur substantial costs.
Mrs H's is having kittens right now but I am just wondering is this a new tactic of scaring me into submission? Or can they actually do this ?
To get a CCJ, the Parking Company (not Newlyns) have to take you to court, you have to lose, and subsequently not pay the judgement.
Of course it's just more scaremongering nonsense, and by the sounds of it, having the desired effect.
Read the letter again, you will notice the absence of an affirmative "will", instead they use conditional words like "may" "recommend" "consider" etc. etc. The condition being that hell has to freeze over first, Newlyns CAN NOT take you to court.
If you want further help follow Stroma's/Slithy's instruction, don't post any more on this thread.

I'm glad that the threads have been merged thanks to stroma and crabman.
We seem to forget that debt collectors letters have this effect on people - it is part of their intimidation and just because we hear of it every day - does not negate the effect it has on people who are unaware of this.
Can you tell us which PPC this is - as we will be able to gauge the likelihood of court action?
You have three options:
Complain to the retailer/landowner - A DEFINITE YES TO THIS.
Continue to ignore the debt collectors and hold out to see if you receive a LBA from either the PPC or either court papers or a solicitor acting for them.
(Note that the PPC have 6 years to start proceedings from date of debt)
Respond robustly to the debt collector denying the debt and instructing them to refer the matter back to their client. If the debt collector continues to contact you after this - then it is harassment.
If they telephone you at work again - politely tell them that you are not happy taking phone calls at work and that all communication should be in writing. Again if they continue to phone after this - then it is considered harassment and you can complain.0 -

I believe it was after the landmark martin cutts court case (maybe read his April 2012 pdf about it ?) and maybe he would knowOn 15 September 2011, a case was concluded at Stockport County
Court (case 1SE02759) concerning a Parking Charge Notice (PCN)
imposed on a motorist by Excel Parking Services Ltd at a
pay-and-display car park at the Peel Centre, Stockport.
The District Judge ruled that Excel had not made reasonable efforts
to alert the motorist to the terms and conditions of the contract
he was supposedly entering into by driving into the car park.
Basically the signage at the car-park entrance was inadequate as
the print was far too small. Excel's claim was therefore dismissed
with costs awarded against Excel.
my own opinion is that it was well before your PCN , so long before march 2013 , possibly more than 1 or more like 2 years ago after the judge ruled them as useless (so around or after the watchdog video etc) in the above court case0 -
I aware that the original sign changed after this case, then but was changed again to incorporate the new hours of operation. I believe that this was some time around July 2013? I was just wondering if anyone had any pictures or could be any more specific on the date?0

There are indeed pics on other Peel Centre threads, which you will find by searching this forum for the single keyword 'Peel'. Apparently the signs changed in July and I am remembering that from threads I read in the Summer, which will appear in your search results and which did include photos.
