Groan. Are newbies incapable of reading?
See post #24.0 -
sorry if this is the wrong forum. I used the template letter challenging fine but have had a reply saying that as I live in Scotland the letter is invalid. They still want payment. Can someone please tell me how to proceed? They want £ 50 in 14 days or £85 if longer.0

Please read very carefully post #32. It's immediately before yours. It's not very long. :cool:Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Might be an idea to post a cut down (5000 Character) initial appeal in first post so it can be used with PE's online systemWe’ve had to remove your signature because your opinion differs from ours. Please check the Forum Rules if you’re unsure why you can not have your own opinion on here and, if still unsure, email forumteam@moneysavingexpert.com0

Instead of trying to hijack this thread - Try reading it!

Used the templates for the soft appeal as set out (slight customisation) and received a letter today from Excel Parking stating in view of the points you have raised we have decided to cancel the notice. Success0

Thanks, used your advice and challenged online our PCN's (mine and daughter in law) issued when visiting a site near Stoke on Trent. We didn't hear back from them for 21 days BUT we both had emails saying they had cancelled the "charge".0

Well done but please read the post above yours!0

DO NOT BOTHER WITH SECOND STAGE APPEAL IF POPLA IS NOT OFFERED, JUST SOAK UP THE DEBT COLLECTOR LETTERS KNOWING YOU'VE STATED YOUR CASE AND ONLY START A NEW THREAD IF YOUR PPC (not debt collector) SENDS A 'LETTER BEFORE CLAIM' OR STARTS A CLAIM.
Can post #1 be updated with the reasoning behind the above statement please? It's been discussed several times before in other threads, and I know there are conflicting opinions. I feel it is important for the WHY behind the above statement to be made clear in the advice thread where it is being made.
I know this post is linked from post #3, but I think the reasoning should be made clearer where the advice is being given.0 -
Will try when I get time.
Basically there is no point making the tennis match with an IPC firm 'advantage IPC member' when you could just not play the game at all. IMHO, there is no advantage whatsoever to an appellant to lose what is dressed up to look like a formal appeals process - some Judges might even believe it has some merit.
IPC - we all know it does not.
People could contact the PPC just to say why they are not engaging with the appeals process and that they are willing to appeal only if the independent appeal offered by the Ombudsman Service (POPLA) is made available. But OP's need to be careful not to then start putting flowery stuff in their letter giving the game away about the driver, or replying to the next letter and putting their foot in their mouth. I prefer to recommend silence.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
