    (5) The relevant period for the purposes of sub-paragraph (4) is the period of 14 days beginning with the day after that on which the specified period of parking ended.

    So 14+1 = 15. :)
  • Hi Nemron. I, too, have received a Parking Charge Notice from APCOA more than 15 days after the alleged incident occurred at Luton Airport so I spoke with the Compliance Manager at the BPA.

    He stated that the 14 day limit only applies to PCNs issued under the Protection of Freedoms Act 2012. My PCN makes no mention of that Act so reading the Notice further one must assume that it was issued for 'breach of contract'.

    I am not qualified to give further advice, so wont, but for the record I wont be paying the ticket.

    If PoFA 2012 is not being used, then there is no keeper liability anyway. :)

    You do know you can still strongly appeal and in the unlikely event of APCOA being daft enough to reject your argument, you can use POPLA to cancel it though?

    'No POFA' doesn't mean 'no POPLA' appeal - and it's as easy as pie as long as you ensure you only communicate as the 'registered keeper' not implying who was driving at all in any appeal words. They shoot themselves in the foot with these non-POFA NTKs when faced with an appellant who realises they can argue 'no keeper liability as it's an Airport, not relevant land and the operator hasn't bothered to establish liability under POFA 2012'.

  • I've been trying to get advice on how to challenge my parking charge but find it all very confusing on here, so many links :( I started a new thread, got told to come here, which says start a new thread????

    I have got a copy of someone else's letter to send, but if the company challenge it, not sure what to do from there.

    Its only confusing because you abandoned your original thread, then started pitching-up on others - despite your clear agreement not to bump threads.

    The advice to read the info threads and similar recent threads in order to help formulate your challenge/appeal is all good.

    Now go and do it! Then post a draft back on your original thread and advice/help will be quickly forthcoming. They can't do it all for you. :)

    We advised you to read this thread, that's all, read the information on it not just look at the blue new thread button! The info in this thread (hopefully) tells you what to do, under the 'POPLA' acronym - you'll need to click on those links once you get a rejection letter. The first post above also explains what all the other typical acronyms mean and how to appeal, with examples. :)

    Here's your thread, when you have a question, reply on your own thread and it gets bumped back to the top of the forum. Your thread is still current and you can always find it by clicking on your own username.

    We also advised you on your thread, to search the forum for similar threads. But as there are so many Airport ones, if you can't get to grips yet with searching, just read the first half-dozen pages on the parking forum, clicking on & reading any thread about your PPC or Airports. And do reply on your own existing thread if you need help!

    C-m, I note your continued frustration that newbies are just ploughing in (often hijacking others' threads) without having read this sticky, which is now the fundamental thread for anyone seeking first-time advice on PCNs.

    I just wonder whether having the title in BLOCK CAPS might make it stand out a bit better at the top of the forum. Anything to stem the daily madness!
