Dear blah,

I do require a reply from you and x and x, who are also receiving this letter with enclosures.

You will see that this whole matter is untenable. This deepens when one is directed to an online 'Appeals' service which bounces back this reply:

You will see that I, as Registered Keeper, have now replicated the journey which ostensibly gave rise to both ‘parking events’. Costs will be verified externally and added to my counter claim.

As stated earlier, I am 65 this Friday, have a beloved family member in New Zealand turning 90 in May. I have saved hard to afford this[realistically final] airfare to be there then and do not want Court dates set during my absence.

I will be counter-claiming my costs.

Kindly read the email sent last night to all 3 elements concerned, being:

'TO WHOM IT MAY CONCERN

I now have your em reply, poorly written and inadequate, despite my helping you by highlighting key questions, not a single one of which has been addressed, let alone answered.!

I have also received by today's post a reiterated demand via an unenforceable 'invoice' from arkingpie Legal Department. It is surprising that this Legal Department is not behaving legally and seems unaware of its Legal obligations.

Ms Burrows, or the person responsible for the landholder, if it is not unwelB or arkingpie[according to your own office] is therefore required to answer:

Please advise me whether or not you are the landowner?

If unwelB is not, who is?
If arkingpie is not, who is?

Is it your intention to pursue me for financial gain, given that there is no quantifiable loss and no contract between any one of the named bodies and me?

I can now add that, at my own cost, I travelled and replicated the 'parking event' circumstances this weekend, again in winter darkness. This was specifically done and will be externally costed in my counter-claim, should it prove necessary.
There is no visible signage re: parking.!
However, owing to confusing and conflicting lane entry points and divisions for cars, trucks, etc. I was one of 5 drivers swept into the HGV area. There was tooting and ill-temper, although not from me. I repeated the entry process, then parked as and where the driver did, during both 'parking events'.!
No error was made in this positioning, the driver having deliberately sought darkness in the quieter backwater at the rear of the carpark, precisely in order to find a dark area to permit sensible and proper rest.!
Only a vertical Waitrose banner attached to a telegraph-type pole stood nearby.
There are no parking notices.
On leaving the carpark, no signage was evident.

You also write:
'All non-essential text is in a smaller font at the bottom of the sign, which can be read once the motorist has parked.'

Wherever any signage is, this is a nonsense: if it is non-essential, why is it there?

If no signage is visible, how is it to be read?

The RD reference for my Royal Mail letter has been tracked online[proof retained for any counter-claim I may issue].

I have captured and retained the signature of the signee.

I now expect a prompt, point-by-point reply and disclosure of evidence in response to each request for information that I have made, in line with your legal requirement to furnish a compliant response.

A generic template does not comply with this requirement.

Where are the POPLA codes for both 'parking events'?!
Do you refuse to supply them?!
Your failure to fulfil this legal requirement, made in every communication sent to you, now numbers eight [now 12 and growing].

Mr McKie, current online opinion does appear to suggest that you have become an apologist for arkingpie. I am prepared to await your response and see if my opinion differs.

Ms Burrows, I hope you enjoyed your holiday and can now suitably address my repeated, accurate concerns, perhaps in consultation with Mr McKie.

Mr McKerney, I address you as CEO of arkingpie , although I note you, also as Company Secretary, and your wife, Sarah, along with Simon Smith and David Taylor are all major shareholders in this outfit, according to publicly available records. I do not yet have details for the other 3 Directors. As and when necessary, I will also be involving them.

Of course, these further hours spent on this draining matter[regardless of writer’s age]are being factored into my Schedule of Costs for the Small Claims Court.

A similar recent case refers to an eye-watering £450 per hour, but I will not be aping this. It is simply dishonest and more than treble my sole weekly income as a pensioner.

I expect a courteous, professional, accurate, point-by-point response to each and every question and challenge I have set out, in articulate language, within 5 working days i.e. Tuesday. 14 January, 2014.
