How did you arrive at £2000 for shock and distress?

That was the smallest amount I could think of trust me.

I have read the ltter again and it appears that they have also refused to pay for I have paid for the surgery that killed my dog. Stating "any medical costs that you would have ordinarily incurred cannot form part of your claim ie the charge for the surgery." So I cannot get back money I have paid for the surgery that killed my dog? That cannot be right.

When you pay for something like surgery, you are paying for the service, not the outcome.

Did you lose £2000 worth of salary because you couldn't work due to the shock/distress. Did you pay for therapy because of it? That's the only way you'd get anything like you've asked for.

They're not going to pay £2k for something that is not tangible, no matter how much you think you deserve it.

I think you need to stop reading and relying on information from American law sites.

As I asked before, if it isn't about the money, why are you rejecting the claim?

I am rejecting it because if I go to court at least this kind of veterinary negligence that is so difficult to fight will be made public. Standing up to the negligent vets is almost impossible due to UK laws and regulations. There are many people like me who had to give up because of the cost involved. To be honest I hoped that they will not pay all my claim so I can do it. The thing is they still might pay my full claim.

You yourself and some others told me I need medical care due to my state of mind.

meanwhile, back in the real world...

If you lose the court case, which is highly likely given you intend to reject a very reasonable offer from the insurers and because you are going to struggle to prove negligence, the defendants may well be awarded costs against you. What with that and the costs you will incur in bringing the case, this is surely going to be in the region of a 5 figure sum, at least.

Do you have that kind of money available?

But I did not agree to this service if pre-op bloods results were not good.
  • But if they offered your full claim, it wouldn't be made public so it sounds like it really is about the money. Or were you planning on rejecting any offer that wasn't "we were wrong"?
