    This is not going anywhere. I will just write my reply to the insurers see what they say and if not happy pass on my case to my insurers legal team. End of.

    I'm fairly certain your insurers legal team would have wanted to be involved in this from day one. If you haven't involved them already it may be too late.

    Don't forget though, Once you instruct insurers legal team to work they are effectively working for the insurance company and not you, you won't be able to call the shots and won't be able to insist on action

    You accept the law is not adequate in this area, you know that trying to clarify or change the law in relation to this is not going to happen in the small claims court and will be prohibitively expensive for almost any individual and you may risk everything on this. Have you considered how you will fund your proposed actions? You will also need a solicitor and barrister to go forward in any meaningful way

    And you may well lose a court case AND have to pay the costs of bringing the action and the costs of the other party.

    That's two people who have made this point, and you have just glossed over it.

    If you don't get proper legal advice now, before rejecting their offer out of hand, it will be too late.

    Do you have a husband, children? How will they feel if you lose your/their life savings just so you can make your point by having your day in court?

    And it won't be the Old Bailey, so regardless of the outcome it probably won't merit more than a paragraph in the court section of your local paper. Some victory that will be.
