    When did you first give them a deadline?
    Was it the 28 dat deadline you were advised to give, or have you chosen to ignore that advice?

    If you've only given them a few days as a stated deadline, then you've list the case already. They will see you as someone who doesn't have a clue what they are doing, and will, quite rightly, treat you as such. They do not know what is going through your mind. They do not know what you are thinking. They do not spend every waking hour thinking "what if". They are only dealing in facts, and if the fact is that you have suddenly given them a 3 day deadline, they will use that against you if you ever get as far as taking them to a courtroom!
    1. Have you tried to Google the answer?
    2. If you were in the other person's shoes, how would you react?
    3. Do you want a quick answer or better understanding?

    As has been said before, they are NOT your insurers, YOU have not put a claim in with them, they do not have to sing to your tune at all, they can take as much time to do whatever they see fit. They haven't even confirmed whether there is going to be a claim, they are looking at the documents you have sent them to decide that.

    I have just confused the dates. It is in fact by this Friday (17) that I have told the brokers that I want to hear from the insurers one way or the other. When the brokers unexpectedly contacted me in November I told them that as I had no contact from the veterinary practice their solicitor or their insurers following my letter dated 23/9/13 stating my intentions I was going to take the legal action on that day. I have agreed to put that on hold as contact has subsequently been made. I have complied with all their requests providing them with forensic vet report and the bills for the monies spend due to Maxie’s death. Let’s face it they had my letter since September plus all files passed on by the practice owner and they did nothing. The only reason they phoned is because they found out that the forensic vet was trying to contact the owner and that I had his report , only then they started treating this more seriously. I think almost 2 months is adequate time for them to read 12 page report and make their decision. If they decide to fight this case I also need to be prepared. Although I have everything ready to go to my insurers legal team I have also put that on hold but should I have to go to court I will still have to wait on my insurer’s legal team to look through my evidence. So while they are taking all the time that they want and getting their solicitors opinion I am doing nothing just waiting and waiting. At least now if I hear nothing by this Friday I will know that they intend to fight it so I can start dealing with it.

    Seems my deadline did the trick. I have only e-mailed the brokers yesterday saying that I am only waiting until Friday and today at 5pm got a letter from the insurers. They have offered me all the monies I have spend due to Maxie's death but only 10% of what I have claimed for shock and distress. The reason for that they said that there is no award under UK law for compensation for distress in respect of the sentimental value of the animal. Well I am well aware of that but I did not claim for the sentimental value of my animal I have claimed for my shock and distress, this is claimable under UK law. So offer will be rejected.

    Seek legal advice before turning down their offer!

    I might be completely wrong but I believe that if they make you an offer and then a court finds in your favour, but at a lower level of compensation than was initially offered, then you could be liable for the other side's court costs as well as your own.

    Now that would be an expensive lesson learned.

    I have read the ltter again and it appears that they have also refused to pay for I have paid for the surgery that killed my dog. Stating "any medical costs that you would have ordinarily incurred cannot form part of your claim ie the charge for the surgery." So I cannot get back money I have paid for the surgery that killed my dog? That cannot be right.

    Just because you don't understand it, doesn't mean it's not right.

    I think someone earlier in this thread might have suggested you seek legal advice.
