Hello,
Please can somebody help me, I am worried sick about my esa benefit not paid into my bank account today. I normally get paid fortnightly on a Tuesday, today it was not in. I phoned job centre this morning the person I spoke to told me I had errors on the screen and asked me if I was in receipt of working tax credit. I'm not.
She said she will try to issue a payment and it would take three hours.
Money was transferred to my account, but not the amount of £213.00 I was expecting but and amount of £190 and the reference was JSA ?
I am very worried about this. My circumstances are,
Claimed esa November 2012
Husband not working but caring for me full time
Married Couple in our 40's
One child school age
Esa support group
Dla for my hrc and hrm
Husband claims carers allowance
child benefit
child tax credit.
Home owner no mortgage help.
From what I have read this evening should I get more than £213 for us both ?

  • Have you applied for Support for mortgage interest? If not do so. When on income related ESA and in Support group you should get it after 13 weeks min. DWP will pay 3.63% of your interest, so if you happen to be on a lower rate, you will be paying off a little capital as well.
    Ask for form ESA3 to get on the income related version. This will also increase your child tax credit to max amount for the year.
    Couple rate for IR ESA in Support Group is a min £169.10/week and there will be an underlying benefit to carers allowance of approx £30.20 on top of that. So to answer the ? Should we get more benefit, then the answer is yes.

    Thank you so very much for your help.
    I tried to claim mortgage relief earlier in the year, I was sent them, I returned them completed and also had the forms sent back to Dwp by my lender. I phoned about a month later and nobody knew anything about it. My condition worsens when stressed so I just left it, my partner is not able to use the phone sadly so its left to me.

    "Couple rate for IR ESA in Support Group is a min £169.10/week" .
    Why do you think I have only been getting £106 per week, they know I am married. This is all very stressful and very annoying to made to feel anxious.

  • Did you complete an ESA3? that is the form that gets you onto Income related ESA. It is this that will get you the SMI and all the other bits.
    DWP may be missing this form so that could be why. Once you know that this is being actioned you can ring up HMRC tax credits and get them to change their records to the Type of ESA you are receiving. They should then send you a new award in due course.
    You would also get free prescriptions for medicine and NHS dental treatment and some help for eyes if you need it. I should know as I did all that in Sept 2012.

    Thank you once again, after reading your reply, I phoned dwp and asked why my benefit was short. I was told it was because my 365 days where up. I explained I was in the support group so that didnt apply to me. I then asked about mortgage interest payments because I remember filling in these forms a while ago. I was told I was getting £49.89 weekly housing costs, I asked how and who that was paid to, he had no idea, said he would get someone to look at it all and write to me in the next 7 days.
    I phoned my mortgage lender who told me they had not received any interest payments from dwp ever.
    Does this sound normal, I'm so very confused.
  • The SMI should be paid to your lender direct - they should pay every 4 weeks in arrears and it does sometimes take a little while for it to get properly sorted out. DWP should send you a revised award letter stating that the SMI amount is being paid direct and due to the clunky way they write letters it may not make sense. It should also set out your ESA payments of the basic amount the Support group element and the Enhanced disability premium of £21.75 couple rate.
    So basic couple ESA = £112.55
    SG = £34.80
    EDP = £21.75 total = £169.10
    Carers underlying entitlement = £30.20? - so possibly £199.30 per week
    Then you should have your HRM/HRC DLA £134.40 paid every 4 weeks.
    Family element of CTC = £545
    Full CTC = £2720 pro rata for rest of this tax year. When you get to process the renewal next year the CTC will get sorted out. But do wait for P60u's to arrive for the ESA and CA first.
    It does take time to sort these things out, but do not let it stress you out. Make a list of each benefit and tick them off one at a time. If you have trouble on the phone, then put it into a snail mail letter and tell them that way.

And even better than that - the infamous benefit Cap that people mention in passing would not apply as you get both DLA and ESA income related Support group. Somebody like Ice queen will know more about the CTC part than I do. BTW I based the child element of the CTC on 132 days from todays date.

    I think I need to understand these premiums more and how they work as I'm not sure everyone I work with gets amounts such as that.

    When did your husband start to receive CA?

    DO NOT COMPLETE AN ESA3 JUST YET...... you have to be careful with this.

    Your husband can claim Income Support for his Carers Allowance and he can claim mortgage help on that. Assuming he is not already claiming Income Support.

    You will get more money on
    IS/CA & ESA C = £211.80 than you would on
    ESA IR/CA = £202.40

    However, you should check with Mikey Bach (on here) if your husband claimed Income Support now, how far back could it be claimed?
    • Would it be backdated to the start of the CA claim? date?
    • Would/could it be easily backdated 3 months?
    • Is backdating actually unlikely to be allowed?
    • If swapping from ESA IR in payment with mort help in payment... to IS in the partner's name would he get mort help on the IS from the start of the claim or have to wait 3 months?
    If Income Support is unlikely to be backdated more than 3 months then I suggest ... as an interim measure.... you should fill in an ESA3 and you should then easily get ESA IR backdated to the November 2012. Then once you have all the backdated money. You could stop your ESA IR & leave your ESA C open and he could then claim Income Support to get more money that you have got on ESA IR.

    ESA IR support group couple would pay 169.10 + 33.30 carer premium = 202.40 and the CA would be deducted to leave ESA IR = £142.65

    The reason you get £106.50 per week or £213 per fortnight is because your ESA is currently Contribution based - you do not claim for your partner on your ESA.

    What was the exact amount you got when you said you got £190.... was it actually £182.57 or £197.78?........ This is strange and could mean your ESA C is closed or suspended for some reason. The reason it said JSA is because all manual payments of ESA are issued under the flag of JSA it means nothing except that it was manually paid.

    Thank you for the detailed replies. I feel swamped under with the pressure of it all. But I'm starting to have a little hope. You can imagine how we are struggling, we have actually got into a lot of debt, and our most pressing need is to get our benefits right.
    My husband claimed carers allowance back in April of this year, it was back dated two months.
    When I phoned them about the missing payments it was because of a 365 day rule for claiming esa but it does not apply to me because I'm not in the wrag, I'm in the support group.
    How do I go about getting this sorted ?

    Just had a look at backdated income support

    Can it be backdated?

    Income Support can be backdated for up to three months before the date of the claim if you would have been entitled to it earlier. You have to have an acceptable reason for claiming late. Request this when claiming.

    Then I read this
    ncome Support can be backdated for one month before your date of claim if, for example, your local office is closed and you can't make other arrangements for claiming, you couldn't reasonably get to or contact the office, you've claimed after separating from your partner or there were serious postal problems. In exceptional circumstances, Income Support can be backdated by up to three months. These circumstances include language difficulties, being given wrong information by Jobcentre Plus or an advice worker or solicitor, or you were having serious problems as a disabled person or a carer and you weren't able to get help.
    If you've been awarded a benefit, such as *** that started at a past date, it may be possible to backdate your Income Support claim to the same date even if this was more than three months ago.
    If appropriate, you need to make a claim for any backdated benefit because it's not automatically granted.
