    So what your saying is our smi arrears will be paid direct to he lender even though we have paid our mortgage. TIA

    SMI is interest only anyway, and if you been paying all of your mortgage, both interest and capital, then when ESA pay the arrears, on your mortgage statement at the end of the it will show the amount you have paid in respect of the interest as an overpayment, this will in effect will reduce your outstanding balance, as the interest for the period of the arrears has bee paid twice

    So if for example ESA pay them £300 arrears towards your mortgage interest, then you will have in effect overpaid your mortgage by this amount, you will owe less as you have over overpaid because you have been paying as well, and as a result the term of your mortgage will be slightly shorter....

    Unless you get in touch with your building society and work some thing out.
    When SMI is up and running you will only have to pay the capital repayment part each month, they may say have a few months break till it catches up,

    You will not believe this !
    I phoned ESA just now to confirm they have definitly sorted out my benefit correctly, and guess what.... "we have made an error" !:eek:

    My claim for ESA last November was incorrectly processed.
    I was not entitled to contribution based ESA.
    I was intiltled to income related.
    I'm not intiled to any housing costs either.
    And I'm not owed any arrears.
    I am so gutted. I borrowed and spent £100 off my Mam getting a few extra Christmas presents for my little one, Im going to have too take them all back.
    Why why why, are they doing this to me ?

    they are shooting them selves in the foot
    If you are entitled to Income Based ESA
    then you ARE entitled to housing costs.
    I think you need to see CAB and get them involved.
    and maybe your MP.
    If you are entitled to Income Based then you are entitled to arrears for your partner and SMI..
    Please make an appointment with CAB or call them back and ask to speak to a team leader
    If WTC stopped in July then thats the date everything should kick in.
    Dont give up :)

    The lady I spoke to in ESA told me I would not of qualified for SMI because I would have been over the threshold ?
    I have not spoken to anyone in the ESA department who could tell me any information correctly. Its no wonder people give up.
    I have phoned the CAB this afternoon and was asked to go in. That's a lot easier to say than physically do.
    My payment on Tuesday will be £184 do you know if this is for one week or two?

    you should have that times two :)
    thats a weekly payment with mortgage help,
    just look at our entitlement letter again :):):)
    think you could have spoken to a call center member of staff

    ESA for you and your partner if you have one the law says you need to live on £112.55

    Dependent children ( name age 7 )

    ESA rate after 13 weeks top up £34.80

    Extra money for you or your partner are a carer £33.30

    Extra money because of special circumstances £21.75

    Help with housing cost £41.89 (we have a mortgage)

    The maximum the law says we can pay you is £244.49

    - your carers allowance = £184.74

    So this still stands then

    you are owed £36.35 per week for your partner
    and £41.89 per week
    mortgage from the end of July to date

    So if I phone again in the morning and ask to speak to a team leader, read out their words back to them, they should in theory action the backpayment ?
