    Given the dates and what you have said on here, YES
    you are entitled to some arrears
    If they have said you are getting £184, and that is the figure that is on the screen
    this ties in with the entitlement letter they said you just a week ago.
    Ok you may not have been entitled to ESA conts but you would have been entitled to ESA IB.
    When the WTC finished you should have got SMI and payment for your partner from July.
    If they have overpaid you ESA conts then it official error up to July
    not your fault.
    They may offset some ESA after July to date if they have paid to much conts, but How have they made this mistake????
    But you are owed arrears
    Think you do need to speak to a team leader and get to the bottom of it
    or a call back from the ESA Maintenance team then another from the Mortgage team.
    Think you need to mention the words I want to make a complaint

    It was definitely an error Mikey because the lady said " they would not recover the overpayment back from me"

    if I were processing your claim
    you have been overpaid and under paid since july
    overpaid £106.50 - 95.01 = 11.59
    but under paid £36.35 for your partner - £11.59 OP = £24.76 arrears due
    so I reckon you are now owed £24.76 per week for your partner from July.
    given on what you have now said, the OP from July will be been off set, but they may not do this and pay you £36.35 for your partner, but I think they will.offset from July and pay you £24.76

    And the arrears of the SMI £41.89 are still due from July from when WTC ceased

    This is now a bigger mess and may take a bit longer but should come to pass

    Yes I agree wholeheartedly a huge mess indeed.
    But at least I will hopefully get my correct benefit on Tuesday. I can check my bank on Monday to see whats going in. If its still messed up I will have no choice but to go into town and see CAB. You have been wonderful. You truly are an :A.

    Keep your CAB appointment they are really good and will hep you.
    Cant understand how they processed it Conts when you were not entitled but stranger things have happened.. Hope you get it sorted very soon

    Do you and your partner have savings over £16,000 ?

    When you phone ESA again don't ask for a team leader there is no point - because the team leader will be a contact centre team leader and they will be able to do nothing and tell you nothing that the first agent you speak to won't be able to do or tell you.

    What you need to ask for is a callback from the ESA claims maintenance. When they call you, confirm with them if you are now on ESA C only or ESA IR only

    If you are on ESA C only there will be no mortgage help
    If you are on ESA IR only there will be mortgage help.

    And you can ask what rate you are on and when will your mortgage arrears be paid
    And when will your ESA IR arrears be paid (working tax now being removed from July)

    If you don't get the callback - and they did not try to call you, you can ask for a priority 1 hour call. If they did try to call you and you missed the call then you can ask for another standard callback. But if the next person you speak to can answer the questions from the notes you may feel there is no need for a callback.
