Mobile Phone Contract - Price Rise Refunds

    Hey Guys,
    Just another quick question. In tmobs defence they calculate the price rise of my contract to be 86p (no mention of VAT).

    In the new revised Tmob defense AND response document it is stated as 97p (excluding VAT). I know the 97p part is obviously going to be different for me but I just wanted to know why they didn't mention any VAT in their response.

    Does that change anything for me in my response??

    ....Good luck! It can be a little daunting but take your time and read everything twice before sending to make sure everything is ok as there were a couple of typos in the reply document I needed to change on mine. It is well worth the effort.

    Much thanks Swampsnake, I have just submitted my defence against Tmobs response to CISAS and received their automated email acknowledging receipt. Just out of curiosity would you be able to post the timeline of events corresponding to your initial complaint and subsequent responses from EE and CISAS.

    How long do you think I will have to wait for my Adjudicator to be appointed and then a decision made?

    First complaint to EE - 21st April
    Application to CISAS - 5th June
    EE's defence forwarded from CISAS - 27th June
    My reply to EE's defence - 29th June (I took 2 days to go through the reply document to make sure everything was perfect!)
    CISAS Adjudicator assigned - 7th July
    Decision - 15th July

    But how about when CISAS make a decision which states

    " I direct that the company terminates the customer's contract with penalty (this being backdated to 4 March 2014) and issue a written apology to the customer "

    I accepted this in the belief that the "backdated" reference clearly makes my contract null and void from the 4th March 2014. I even referenced refunds in some of my emails with EE getting my PAC sorted


    Any Advice welcome as I was just about to complete my Money Claim Online


    I'm not sure if the SCC would get involved in this or not as it stands.
    A possible way around this is to send EE an invoice for the sums taken from your account after the contract was cancelled - and then when they refuse to pay it take them to the SCC for non payment of an invoice.

    I have completed the Vodafone Ombudsman claim and will post it here and on the Fight Mobile Increases website tomorrow :)

    MSE have acknowledged that they have the info I sent to them to consider giving us support for the new campaign. If I have heard nothing by Monday than I think we will just make a start.
  • In brief because I'm away but ANOTHER WIN against EE using new response to their defence. Cancellation, refund of all charges back to April, PAC code and £50 compensation.

    No definitely not. Only 77% out of 50-60 odd of us have got their money back. There are at least about 50,000 times this number of customers who have silently accepted the hike and the company is still minting money.

    I've just sent Lynn Parker another chase to answer the 2 simplified questions we asked over 60 days ago. I'll be escalating to Graham Howell on monday when i don't get a response, unless RC you think i should hold off a little longer...
