No sign of a response to my emails yet - sent Tuesday. Probably not helped by the Which? campaign that is presumably also bombarding him with a ton of emails!
I've just sent off an email to them now, and I noticed on WHICH that they are getting thousands of people to email them about this price rise. Crazy how they want to hike the price all the time, I pay enough in the first place!

Just to clarify, I and my daughter have just received the price rise notification dated April 7th.
I've been a T-Mobile customer for 5-6 years and my daughter signed up with EE last August 2013, and so we're both good to go with Randomcurve's template?0 -

On the email template the last two paragraphs seem to be repeatedWithout Prejudice
In the Ofcom publication “ Price rises in fixed term contracts - Decision to issue Guidance on General Condition 9.6”, Published in October 2013. Ofcom defined “Likely to be of Material Detriment as follows:
Paragraph 6.22
“In particular, we consider guidance is needed as to price rises which we are likely to regard as materially detrimental (or likely to be materially detrimental) and invoking the requirements of GC9.6. Such price rises are likely to include any increase to core subscription prices.”
The above definition is to apply to contracts agreed to on or AFTER 23rd January 2014. However as EE updated its’ price variation clause effective 26th March 2014 (2 months after the date to which the definition applied) then this clause of the contract was effectively agreed to and signed up to post 23rd January and therefore as per the Ofcom guidance in regards to GC 9.6 the increase in core subscriptions price is likely to be of material detriment to me.

Hi - yes you can use the template for both contracts, and the Template does deliberately repeat the points you have highlighted as the "without prejudice" means each point is separate.
The two separate points are:- As EE changed the T&Cs after the 23rd Jan then the post 23rd Jan definition of Material Detriment (MD) should apply;
- The second point is saying that as the words of GC 9.6 have not changed, then the definition is the definition and so the post 23rd Jan definition replies regardless of anything else.

Have sent the email off
Wait and see what comes of this
I switched tariff in December last year from my £26 per month with 750 mb to the full month unlimited data for £27.99 with no change to my contract period which ends Jan 15.
That is the price I was quoted and I'm sticking with it.
There was no mention of it going up ever.
I specifically asked this at the time
I have already cancelled one EE contract in February when my wifes 2 year ended due to poor service and value
choosing to go with Vodafone as they were offering far more for far less money
I hope I can get rid of this one too now
I'm sick of the big companies ripping Joe public off
(Gas and electric take note !)
I recently contacted EE with a view to getting my contract changed over to 4G even offering to pay more per month
All they could offer was for me to pay off my current contract at a cost of over £300 and start a new one with them
Needless to say I had a few choice words with them about me never using EE again in the future.
Greed is all they're about
