Got my decision today - Good news, the claim succeeded in part. Contract can be cancelled free of charge, £25 compensation, PAC code and any charges backdated from May 7th.
My adjudicator was Claire Andrews.
Thanks to RC and everyone else who has posted in this thread for the help.
So what happens next? Are people holding out accepting until the 6 weeks are almost up? What happens once you accept? I assume you need to phone EE to cancel and get your PAC code?
I had exactly the same. I am now currently arguing what is meant by backdating with EE who have asked for the arbitrator to decide
I beleive that it means that all charges made from the backdated date have to be refunded ( else what is the purpose of a backdating )
EE are arguing that it means no more additional charges are made from now ( Although contrary to their assertion they did take out a DD on the 1st of July when I ported out on the 27th *)
Having to wait for the arbitrator to define what they meant now which will take 5-10 days!
They are really being annoying especially as they also managed (According to my new provider) to mess up the porting and didn't provide the files to my new provider so have been 5 days without a phone!0 -
Good old EE, they are now arguing whether I should be backdated for the monthly contract cost, the adjudicator said in his decision; "I direct that the company should: provide the customer with his PAC and allow him to cancel his
contract without penalty backdated to 13 April 2014; and pay the customer compensation in the
sum of £50.00."
I took that as meaning I will get the line rental costs I have paid since putting the claim in however they disagree and asking for the adjudicator to comment, am I right in thinking this?
At the end of the pdf it does say "I therefore direct the company to: cancel the customer’s contract as of 13 April 2014 without
applying a penalty for doing so; provide the customer with a PAC; and, pay the customer the
sum of £50.00 in compensation."
Surely that means that any payments after the 13th April should be refunded?

If CISAS to go with EE on this then you will need to write to CISAS and ask them in what context is the contract back dated as per the adjudicators decision if the sums taken are not refunded. We will cross this bridge if we get to it.
Thats was exactly the point made by myself to CISAS and EE. If it does not mean that the effective date of cessation of contract is the backdated date and therefore any charges made after that are invalid and should be refunded I struggle to understand what it could mean!0 -

I intend to wait for CISAS's response as I can't see how "backdated" can be intepreted in any other way as effectively EE interpretation means no backdating has occured
If they do come up with some extraordinary decision I will take it through CISAS complaints procedure and then through OFCOM as if they side with EE they are in my opinion changing their decision0 -

Hey fella, hope you are well, or at least better than you've been recently. What's the latest news on the next step for us that failed at CISAS with EE/T-Mobile? I understand you are very busy with the Ofcom and Vodaphone stuff right now!0

Well I know with things like benefits and council tax, backdated means you get paid back after an application or a decision has been made, usually whilst going through the process of applying for benefits, or before a claim, so I don't see why EE need a definition, and making it so complicated! They should listen to the adjudicator unless they want to be sent to the SCC! Sorry if I've made it complicated, it's what I've just searched up on google. I'm gettin increasingly annoyed with waiting!0

Pleas see the reply that i have had today from Voda. This is the 4th email from them, but this differs to the others with the line....
we currently cannot advise any more than previously discussed.
Has any others had this? I'm wondering what the next step should be...

We have looked at your account and your number xxxx will not be affected by more than 10% of the bills and so you are unable to cancel the contract with no early termination fee at this time.
Although we’ll be increasing the prices you pay outside your monthly allowance, we promise we won’t put up the monthly charge you pay for your plan when you stay within your allowance. This is our commitment to you for as long as your agreement lasts. If you find yourself going outside of your allowance in the future please call us on 191 and we can review your usage and make sure you’re on the right plan for you. with the right amount of minutes, texts and data , so you can enjoy a worry-free mobile experience.
All of the above changes will not affect your eligibility to upgrade 75 days before the end of your contract commitment which is 23/06/2015.
We trust this clarifies things for you. Should you require further clarification please call 03333 044 763 between 8am-8pm 7 days a week and speak to one of our team.
This number is comes out of the minutes on a Vodafone Pay Monthly phone. Calls from other lines are charged at local rate.
