Mobile Phone Contract - Price Rise Refunds

How long will it take for cisas to reply? I find it unbelievable
If CISAS to go with EE on this then you will need to write to CISAS and ask them in what context is the contract back dated as per the adjudicators decision if the sums taken are not refunded. We will cross this bridge if we get to it.0 -
EE quoted that you have to use the PAC in order to cancel the contract fee free.
Give Ofcom a call and tell them that you want to cancel your contract without porting your number to your new network, but EE are refusing to cancel the contract unless you use the PAC code. Ofcom will give you the words to use for your response to EE.

Thank you as always RC, will let you know what they say0

Ok, I have been allocated adjudicator DT to see over my case. Hope he has a professional approach to RC's revised defence. Ultimately, for a positive result!0

Some good news.
One of the adjudicators who has always ruled in favour of EE has - based on the revised defence response - awarded a penalty free cancellation
The adductors decisions seem very much being based on what they consider to be the claimants "individual circumstances" rather than the general application of the rules - strange.
If you have not done so please send the Ofcom email FMI-4-x from the Fight Mobile Increases website - thanks

Response received. Ignoring the questions yet again and quoting the usual 10% response.
Good afternoon Mr
Thank you for contacting Vodafone,
As requested please find an email response to your complaint below.
We understand your concerns around our recent communication about the changes to our out of bundle price increases.
We have looked at you account and your number xxx will not be affected by more than 10% of the bills and so you are unable to cancel the contract with no early termination fee at this time, as per the terms and conditions of the contract.
Although we’ll be increasing the prices you pay outside your monthly allowance, we promise we won’t put up the monthly charge you pay for your plan when you stay within your allowance. This is our commitment to you for as long as your agreement lasts. If you find yourself going outside of your allowance in the future please call us on 191 and we can review your usage and make sure you’re on the right plan for you – with the right amount of minutes, texts and data – so you can enjoy a worry-free mobile experience.
All of the above changes will not affect your eligibility to upgrade 75 days before the end of your contract commitment which is 23/02/2015.
We trust this clarifies things for you. Should you require further clarification please call * between 8am-8pm 7 days a week and speak to one of our team.
This number comes out of the minutes on a Vodafone Pay Monthly phone. Calls from other lines are charged at local rate.
Kind Regards0 -
Now received same reply to all four suggested emails to Vodafone. What do I do now?
Thanks0 -
Unbelievable - we could not have made it more clear that we are referring to GC 9.6 - and still on the fourth time of asking they only respond with the Contractual terms. I will prepare a final email before we seek to take this to the Ombudsman.Response received. Ignoring the questions yet again and quoting the usual 10% response.

Just phoned Vodafone myself - I have no contract with them!
I asked why they are side stepping the issue after 4 emails and asked about GC 9.6. Yet again they repeated their 10% rule so we went around in circles for a few minutes before they put me on hold to find someone who would explain - in the end they claimed that the only people who could help were on the eforum (funny place for the legal staff to be working). So I will post a question on their Eforum later.
They also said the Ombudsman won't take on the case as it is to do with the business decision, but I informed them it is not Vodafones business decision to increase prices that is the issue it is the breach of GC 9.6 and not granting a penalty free cancellation!0 -
