Definition of an offensive weapon:
"any article made or adapted for use for causing injury to the person, or intended by the person having it with him for such use..."
So, for instance, a kitchen knife would not be an offensive weapon unless the user intended to use it for injury
As for the size, that is from having a pointed or bladed article in a public place - criminal justice act 1988
Folding pocket knives are excluded if the Blade is under 3 inches.

My previous post was clarifying definitions for you to clear up your confusion, rather than relating it tot he op's daughter.

you were mixing up offensive weapons with points and blades, and assuming that any knife is an offensive weapon, which isn't true

Let's not argue semantics..
A threat of violence was made on a social networking site and is auditable and traceable (to a degree).
The OP says he forgot to tell the Officers of this threat which was made prior to the incident he did report.
He also didn't get a crime reference number and, apparently, the threat does not appear to have been viewed as a serious matter.
I suggest:
- Call in to the local station and insist on making a formal statement.
- Be clear that this was a clear and direct threat to stab your daughter.
- Take screen prints with you.
- Impress upon them that you feel the threat is credible and that the recent incident of the youth confronting your daughter with a knife adds to your fears.
- Advise them that you do not consider the category of knife relevant as the youth threatened your daughter and had the means to harm her. The 'weapon' is a side issue.
- Advise that you believe this to have been a criminal act and therefore it is a police matter regardless of one instance occurring on school premises.
- Finally, leave them in no doubt that you will hold them personally responsible for any harm if they fail to take steps to address your concerns.:hello:0 -
Why wait until the morning? I know you can't do anything about the school tonight, but as far as the police go I would be on the phone to the duty Inspector right now (they work around the clock) to report the police officers who visited you. They were outrageously incompetent. :mad: Do not be fobbed off! He/she is obliged to follow up any complaints.
I would also insist that a statement is taken from your daughter whilst the incident is fresh in her mind. The young man who threatened her should be visited by the police tonight.

I agree that the 'definition' of a knife as an offensive weapon is a 'side' issue. The actual point is that Dori2o's DD was threatened with a weapon - and neither the school or the police have taken this seriously! which I find totally out of order.
I had an issue with my own son with serious bullying and only called in the police after my son got 'beaten' up. and the officers responding wanted to know why I hadn't called them in before! tbh the police were great - they did far more than I expected from them as the 'bullies' were of 'of age'. but the school didn't like me calling them in. and became even more unreasonable. I ended up taking my son out of that school and enrolling him in another. where he was far happier.0 -
If there was another child with your daughter when this happened then I would make sure their parents are aware of what occurred as their child was also at risk. If you are intending to ask this girl to back up your daughter's version of events it would be wise to do this with the other parents cooperation and knowledge.0

Dori - I would not take your DD into school tomorrow. this is between you and the Head and don't get fobbed off with anyone less. this is SERIOUS! I would also take the letter which you have prepared withdrawing your DD from school if this boy isn't immediately excluded. and if they wont or cant guarantee her safety - then give them the letter and go home. You wont get in trouble, honestly! I feel you are worried that you will be taken to court if DD doesn't attend school - you wont! you have rock solid reasons for not sending her to that school! she isn't safe!0

It's an automatic exclusion at my DS's school for having a knife on them, even if that knife is due to using the same rucksack they took to go fishing at that weekend (HT told us how strict they were re this when we viewed school) so I'd be asking school what their policy is? Also put everything to school in writing, I find they become lots more efficient, once they have something that can be proven.;)
No idea, re police unfortunately. I've also had an incident concerning one of my kids where they've said 'can't do anything about it'0
