Ah... you may have some success with that, but as you told us earlier... "The Company is based in Ohio and no doubt Ohio Laws will apply".0 -
Walmergreen, thanks for providing the link.
You said in your first post "A member of my family has just been caught with this scam".
Was that earlier this year? Or maybe last year sometime?
You see, I am trying to help you by looking for a version of that webpage which may've been the one your relative saw... i.e. without the T&Cs on it.
If we can find that then your claim against Halifax will be much easier.
I am sorry to say that all versions of that webpage going back to the middle of last year do show the text you mention:
Here is 7 August 2013 version of that page:
Walmergreen - Wealdroam has tried to help, and yet you are nothing but rude to him. Very strange when this is what you were asking for.
In your first post you stated that when your relative made the purchase that there were no visible T&Cs. Wealdroam has looked for cached copies of the site in support of this assertion. Why not give him the date of the transaction so that he can provide you with the evidence so that the bank can be pursued for a refund?0 -
*I MANAGED TO GET A REFUND EVENTUALLY FROM RASPBERRY KETONE FRESH* PLEASE READ*
So I fell for this ridiculous scam too and went through all of the same emotions - anger, upset and feeling like a total idiot for falling for this stupid scam. Anyway, I spent a long time trawling through the forums to find out how I could get a refund and this month my refund of £134 (not the full amount) was given back to me. Although it was inconvenient, I was not as much out of pocket as I thought I would be, and I feel a little sense of achievement that the cowboys who set this scam up did not win...here's how I did it:
*I rang my bank as soon as I found out I had been scammed. They were no help advising I needed to wait until it showed on my bank statement before they could do anything, which would take up to 48 hours and the money would have already gone by then.
*I rang Raspberry Ketone Fresh. The first few times I rang the number there was no answer. Do not leave a message, there is no point - they will not ring you back. When the voicemail message came on I just hung up. I noticed that every time I rang back for a third time in a row they answered. Just persevere! I think it is another tactic of theirs not to answer the phone! I also rang at around 9pm each time so this may also be another useful tip.
*When they finally did answer the phone, again they were no help whatsoever advising that the product had already been processed (even after only 30 minutes). I asked how I could get my money back. They tried to talk me into the rebate option. I would personally not go for this option. The rebate form you need to send off will go to an address in the USA. It is harder to track the form and chances are it will take too long to get there by the time you get the form, by which time you will miss the deadline for the rebate. This is part of the scam. I told them I wanted a refund and they advised me to send the pills back when they arrived, with the bottles unopened. As I chose the refund option they told me to ring back when I had the product for the "RMA" number which is supposedly needed to process the refund.
*I waited for the product to arrive. It came within 4 working days.
*When they arrived I rang the company back and advised that I did not want the product (again I rang at 9pm and they only answered on the third attempt). They gave me an RMA number (Which is around 17 digits long!) They also gave me an address to send the product to and told me to include the RMA number and order number on the address.
*NOW HERE IS THE INTERESTING PART (and all part of the scam). The address that is on their website and also the address that they give you over the phone is an INCORRECT address. I found this out after searching forums for hours. You need to send the product back to the address on the front of the package. I cannot remember what this is but it says on the package "If package undelivered please return to:" This is the address YOU NEED to send the product back to. Above the address write Raspberry Ketone Fresh, attn. Fulfilment centre, and underneath this put your RMA and Order numbers. Then put the address on the front of the package
*I sent mine recorded and tracked delivery which was around £6.
*When I checked online and saw it had arrived I rang the company again (yes at 9pm and yes they answered on the third attempt). They tried to tell me they did not have the product though I told them I had sent it recorded and tracked delivery and therefore had the tracking number. They soon "realised" it had in fact arrived. They then advised I would get my refund within 35 days, with a line on the end "If for any reason the money is not bank in your account in that time please contact us", at this I knew the money would not be there after 35 days and sure enough it wasn't.
*I rang back after the 35th day, again at 9pm, and advised the money was not there. They then said "I will process the refund now", so by this they were clearly saying they had not processed in it the first place! They advised this time that the money would be back in my bank in 7 working days and quicker if I was "lucky".
*The next day the money was back in my account.
The number you need to ring for the company is 0800 404 6960. There are a few different numbers around on the internet but this is the one I had success with.
The people who run this scam want you to give up. They make it hard for you and think that you will just give up and not pursue the refund. To get the refund is actually quite easy. It just takes perseverance. I really hope this helps at least one person!!!0 -
GOT BACK EVERY PENNY
Immediately cancel your card
Explain that you have been on a dodgy looking site, realised at the last minute, after filling in your card details.
Explain the screen froze and you never completed the transaction but you are concerned and want to cancel your card (note the time and date)
They will still take your money, but don't panic.
Once they have taken your money, phone the card company again and tell them everything that you already told them when you cancelled your card.
Explain you never confirmed the purchase, immediately cancelled your card and DID NOT receive any products. (If they have not got your signature to say you received them, I'm sure you never got them.)
The credit card company will send you a form to sign and you will get back EVERY PENNY.
You need to be quick cancelling your card though, and putting up with the hassle of waiting for a new one. Better than losing £150 though.
This is exactly what happened to me. I went to do some research, opened another web page and when I went back to the ketone page it had frozen and timed out. I never confirmed anything but thought I had better cancel my card just incase. Got back every penny.
Good luck0 -
Thank goodness I checked this out BEFORE I entered my payment details. Although the small print did say a monthly restock charge of £94 would be taken until I cancelled. Decided not to proceed as others seem to have had issues with communication and cancelling of subscriptions etc.0

Just wish I had come here before I fell for this racket.
They may wish the same after the last few days with my enquiries.
Of course they use Recurring Payments (Continuous Payment Authoritities) to collar your cash.
There is other good MSE advice on this.
Absolutely Insist to your bank that they MUST cancel any payments.
Many bank call takers do not know that it is a legal requirement for the bank to cancel further payments if you ask them to.
Any payments made after 24 hours should then be refunded.
I have found:
The call centres for the Raspberry Ketones product ‘Nutriberry Slim’ & Health Supplement ‘VitaCleanse’ are in Clearwater Florida.
A freephone for them exists.
0800 546 0185
(at least I sincerely hope it was free for my hours talking to them
and
Also their product return address is happily in West Lothian Scotland.
Hassle the devil out of the call centre,be imaginative & think out of their box always insisting on speaking to a Manager if you fancy something to do to while away a wet day.
Or if you cannot understand them.
Dont rush your answers, spell things out slowly to them.
Be polite but very firm with them.
Suggest to them that as you made your purchase through a UK company in the UK it is our laws of contract that are perhaps flawed & give them the chance to make a FULL refund before you take it further in the UK.
They record conversations but unlike UK do not advise you of this.
Ask if that is OK under their Data Protection Laws.
After a hard day for them on Friday and some of more similar trouble today they may alter this policy (as it can work against them!)
Many and varied are their people but their call centre menu does seem very limited, it is THEIR menu, try them with your own.0 -
Hi All
I fell for this scam but later read the terms and conditions.
They had failed to comply with their own terms an conditions buy not sending me a confirmation email.
I emailed their support address and they cancelled my order due to me threatening them with trading standards.
But to get my money back I had to ring them. Which I did.
I spoke to a lady who had said that the email had been sent and that my goods were dispatched.
I challenged her and she put me on hold to speak to her supervisor, she then came back and offered me another shipment, which I refused, then the offer was 50% of my money back. Which I again refused!
I again mentioned that they had breached their own T&C's which meant they couldn't uphold them against me.
Full refund will be winging it's way to me in 3-5 days! fingers crossed!
I took the ladies name so will have come back if I don't see my money by next week!0 -

Or did they perhaps say thirty five days?
It's just that another poster told us a few days ago:They then advised I would get my refund within 35 days, with a line on the end "If for any reason the money is not bank in your account in that time please contact us", at this I knew the money would not be there after 35 days and sure enough it wasn't.0 -
Are you sure they said "3-5 days"?
Or did they perhaps say thirty five days?
It's just that another poster told us a few days ago:
I hope you are right Chezza, but just be prepared for it to take a little longer.
Hi thanks but they did say 3-5 days as I had to ask her to confirm and repeated.
and if it is not there "Jane" will feel my wrath. Ha ha.0 -
Complete scam, it's a disgrace I have to been the subject of this scam the company Sheridan Labs only have a US call centre. I got in contact with the distribution company who I also think are involved and intend to get the police involved as they used my sister credit card so the bank are also investigating. This scam must be stopped. I would also suggest that pressure is place on the distributors, here are the details:
