thanks for all the post
just read mums letter and attached to it, is the entitlement award stating 2 awards one for mobility and the other for care. both dated for 10/4/2003.
mobility she has been recieving from that date, however never recieved care allowance. So hopefully this confirms the back pay.
once it arrives i shall post to tell you all how much ok thanks;)0 -
Is she on other benefits, as it could mean that she should have been getting other monies paid to her over the last 10 years as well, some benefits attract a disability premium as well when DLA is in payment and there is also the Xmas Bonus that it can trigger which is another £10 a year.
If you don't mind putting on here details of any other benefits/pension she has been getting, someone will tell you if there is anything else to enquire about.0 -
Hi simon
mum gets pension credit of £141 per week along with the mobility payment of £55. That's all but now been awarded the low rate care part of the DLA.
she gets no other benefits just the £196 a week.
Thanks0 -
My mum was underpaid on her IB benefit for 10yrs, only found out because someone posted on here their rate and I questioned why they were "getting so much" LOL. DWP finally paid the back pay but also, and I had to remind them of this, interest albeit at their "calculated rate", but don't forget that.0

What counts as income?
Income that's taken into account includes:- State Pension
- workplace and personal pensions
- most social security benefits like Carer's Allowance
- an 'assumed income' of £1 a week for every £500 (or part of £500) of 'capital' you have over £10,000 (capital includes savings and investments, and property that's not your main home)
- earnings after tax and expenses from employment or self-employment, less half of any occupational or personal pension contribution you make
- Working Tax Credit
- Attendance Allowance
- Christmas Bonus
- Exceptionally Severe Disablement Allowance
- War Widow's Supplementary Pension
- Disability Living Allowance
- Personal Independence Payment (PIP)

Hi
my mum has been recieving dla mobility higher rate since 10/4/2003 and i applied for the care component part for her. she is now 73.
she has been awarded the low rate of the component part at £15.15, however the date they have awarded it from is the 10/4/2003 the same date as when the mobility was awarded.
does this mean she will be entitled to ten years back pay>
£15.15 x 4 x12 x10=£9446???
is that right? thanks
Very interested in this for my own personal reasons.
Was a DLA claim for the Care component made with the Mobility component in 2003?
And the DWP only made an award for the Mobility element and ignored the Care claim?
If that is the case, your mum would have received a decision notice only awarding the Mobility element. Did she appeal against that decision bearing in mind that the Care element had been claimed for also?
The reason I ask is that I have just lost a claim for backdated monies (£27,000 + interest) that the DWP say they owe me but can't pay it to me as I didn't put an appeal against the decision years ago not to award it. They overturned the decision not to award me to it being due after 9 years of arguing but couldn't change the original decision as no appeal was made.0 -

You seem to of blown your cover very early Andy...seems your slacking and losing your touch;)0 -
Dear Tony
My mums was only awarded the mobility in 2003, as she did not apply for the care part.
ten years later on the 8 aug 13, I applied for the care component part as mum needs help now at the age of 73. The letter dated 17th October 13 states, she will continue with the higher rate of mobility, however they have now awared her the lowest amount of the care part of £15.15, and the date of the award is 10/04/2003 the same date when the mobility was awarded.
the letter also states the money we owe and future payments will be paid with your state pension.
My understanding is that she should have been awarded the care part in 2003 and for some reason they didn't pay and mum didnt chase up, i guess.
they are doing the calculations ow and shud pay next week. will there be interest on the money she owns??0
