dla back pay- ten years

Hi

my mum has been recieving dla mobility higher rate since 10/4/2003 and i applied for the care component part for her. she is now 73.

she has been awarded the low rate of the component part at £15.15, however the date they have awarded it from is the 10/4/2003 the same date as when the mobility was awarded.

does this mean she will be entitled to ten years back pay>

£15.15 x 4 x12 x10=£9446???

is that right? thanks

  • Long term back payments are not unheard of but they are very rare, and would only happen where there has been maladministration. I expect it is an error, but you would need to call them to be sure.

    just spoken to mum, dla in blackpool confirmed it is ten years back pay- wow and also she will be paid at ten different rates one rate for each year,starting from £15.15 in 2003 to £21.15 in 2013. very shocked

    You also need to recalculate your Mum's backpay. There should be 10 different weekly payment amounts one for each year. DLA is paid 4 weekly and there are 13 payments each year not 12.
    So 2003 = 15.15 X 4 = 60.60 X 13 = 787.80
    If you look up the rates for each year since you will get a very nice surprise. It might also be worth checking if anything else has been underpaid if she gets anything else.

    2003 - 15.15x4x9 =545.40 from April 2003
    2004 - 15.55x4x13=808.60
    2005 - 16.05x4x13=834.60
    2006 - 16.50x4x13=858.00
    2007 - 17.10x4x13=889.20
    2008 - 17.75x4x13=923.00
    2009 - 18.65x4x13=969.80
    2010 - 18.95x4x13=985.40
    2011 - 19.55x4x13=1016.60
    2012 - 20.55x4x13=1068.60
    2013 - 21.00x4 = 84.00 since April = 84.00x7=588.00

    Total underpayment from April 2003 =£9487.20 or thereabouts...........

    I would say its quite unusual but if it is their mistake and she should have been getting it all the time then it is only fair. You should get a complete breakdown of what they owe her, make sure you check it.

    After she has it in the bank, then enjoy it but I would wait until you have it.

    Juat curious but given that you're only allowed certain limits on 'savings' for ESA and presumably IS or whatever, would receiving such a sum affect these? No doubt had she received her entitlement over the years it would have been put to use and not been an issue but receiving it as a lump sum, how does the DWP view this, can she just keep and put aside that sum and disregard it? Only curious here.

    I only hope that the claimant gets what is owed to her and usually any DLA payments are disregarded for income...

    thanks simon for doin the calculation, I hope it is their mistake and she gets all the money as stated in the letter and from the follow up call. The lady on the phone was suprised to but said to mum 'better late than nevere' so it is correct. they told mum it should be with her in two weeks from the the 17th october.
