Parking Eye - Aldi

trisontana wrote: »I actually phoned in July of last year, before all the subsequent POPLA decisions were known about. So I wasn’t on so sure a ground as I would be now. From the start she was on the defensive and aggressive at the same time. She came out with a sob story about all the Aldi shop managers with empty shops and full car parks, because of all the non-shoppers using their car parks.
I asked her about so-called losses that supposedly had occurred, but she said wrongly that PE go after motorists over a “contractual obligation” and not over losses. All nonsense of course, as all POPLA decisions are about GPEOL and not about contractual agreements.
On the subject of POPLA, she made the extraordinary statement that the reason PE lose so many POPLA decisions is that PE are not in possession of all the facts when a “soft appeal” is made. If PE knew all the facts then they would allow more appeals and the case would not have to go to POPLA. She blamed forums such as this for that state of affairs and for advising motorists only to make a minimum appeal in the hopes of getting a POPLA code.
I had the impression that she was working to a script supplied by PE who see themselves as the injured party at the mercy of various parking forums. At that point I just gave up as I could see I could not make her see my point of view.
TBH, I have to say that Rachel was very personable and my experience was very different to what I was expecting. She did actually seem very flexible and was happy to cancel the parking charge once she has established that I regularly shop at Aldi.0 -
Go for it - doesn't hurt anyway.

And until you get confirmation from PE (in writing) that it is cancelled then it's not yet confirmed ... It ain't over until the fat lady sings.

I'm just a little concerned now that Rachel has confirmed verbally that the charge is cancelled but the time to submit a POPLA appeal is limited. I kind of wonder if I will get confirmation from PE that it's cancelled in the next day or two or whether I should submit my POPLA appeal anyway so I'm covered irrespective of what happens?0

When's your POPLA appeal submission deadline? (The NEWBIES thread has a link to where you can validate your code - http://www.parkingcowboys.co.uk/popla-code-checker/).0

I don't know because I'm away from home and haven't seen the docs from PE. They only arrived this week though so we should have a bit of time0 -
That means you should have until about the end of this month to file an appeal.
If there is nothing in writing to confirm the cancellation by the end of next week I'd suggest filing the appeal.0 -
Stonker - please do submit the POPLA appeal anyway - it will not affect anything your end. Post it up here if you like for checking.
The cynic in me smells a rat - Remember Lainee - she was issued court papers and was assured that the principal (in this case the Range would cancel the charge - they didn't and she got a CCJ default judgment - read her story here:

YOU MUST SUBMIT THE POPLA APPEAL BEFORE EXPIRY UNLESS YOU RECEIVE WRITTEN CONFIRMATION BEFORE THAT IT HAS BEEN CANCELLED FROM PE.0 -
ok. I need to spend a few minutes checking it again and will then post it
At what point to PE have to pay?0
