Facing dismissal because of a mistake

    I'm now off sick as I didn't go to the meeting today. I have a small savings pot, my OH is working and we will manage.
    Even if I'm not sacked I can't go back. I dread to think what's been said to my team and customers.

    How humiliating.

    Nothing should have been said to your team and customers, a disciplinary is supposed to be a private matter, for the reasons that if you arent given a warning, or even if you are and not sacked, you should be able to slot back into your job without everyone knowing whats gone on.

    My deputy goes out drinking with the team, and lives with one of the supervisors.

    It's one of those stores where they are in each others pockets.

    You might not be entitled to benefits anyway due to your OH being in employment, but if you have paid class 1 N1 contributions over the last 2 years I think, you should qualify for JSA contribution based for 6 months, Im not sure if thats irrespective of what your OH earns or not, but check out what you are entitled to.
  • In terms of benefits, the same sanction would apply whether dismissed or if you resigned, so I would not let this be a factor in your decision. It may be worth asking if you could resign with an agreed neutral reference. They do not have to offer this, especially given the weight of evidence against you, but they may be willing to do so to put an end to the situation.

    Try to get some fresh air today. It might only be a temporary relief but will hopefully help to clear your head a bit.

    I think you should not resign. As others have said this could affect your benefits.

    If I was in your position I would attend the hearing and give your side of the story. Do not get into a situation where you make accusations against the AM. Just give the facts and let them speak for themselves. Admit what you did was not correct but insist that it was not your intent to defraud the company. Evidence this with the fact that you had your postage on a separate receipt. Do not bring hearsay into the discussion regarding actions of the AM and comments he made to other people.

    With regards to statements made by the AM, cast doubt on their statement by asking why they obtained a separate receipt if it was all to be paid from petty cash. Do not suggest that the AM may be doing this vindictively but state that you cannot understand why he would not remember the conversation especially in light of the second receipt.

    It may also be worthwhile pointing out that the AM never advised you that this was wrong especially as you say he had experience in this field. They are an assistant manager and not just a regular employee so they bear some responsibility in pointing out when things are not been run correctly. They cannot just hide behind the excuse that they were doing as they were told.

    I would not make too much issue regarding you struggling to cope with the work load as this may go against you. Try to stay calm and focus on good work you have done while at the company and how you have had no previous complaints against you.

    Study the disciplinary procedure closely and ensure they are following correct procedure. One issue you have against you is that due to your time worked there they do not need an excuse to let you go.

    Remember you are allowed to have a union rep or work colleague in with you for support and the company may allow a partner or friend in for support if there is no one else.

    I'd rather not claim anyway.ive enough to get by for two or three months if I'm careful.

    The OP has said in previous posts that theyve been under a lot of stress lately.

    If someone feels like they cannot go back, thats the way they feel. If the OP can manage on what her OH earns, then theres less pressure to go to a disciplinary than if they were on their own and having to claim benefits as a single person.

    But as I said before, bear in mind, your employer doesnt have to give you a reference for a future job

    Also, it could be possible that the outcome wouldnt be dismissal and due to that, if I were the OP, Id go through the process when I was well enough, then try and get something done about my working conditions

    But we all deal with things differently and its a decision only the OP can make.

    Any claim would be based on tax years 11/12 and 10/11. CB JSA does not take into account household income or capital, but could still be sanctioned.

    Yes I am sick. I've barely eaten since Friday. I spent Friday night and most of Saturday vomiting and migrane from crying so much.
    Yesterday I blacked out and fell down the stairs.

    I'm very weak and an emotional wreck.
    I'm not sleeping and I am stressed and full of anxiety.

    Every time I start to talk about it I just end up crying.
