    My wife got a cheque back for just over £100, however the account had the wrong spelling of her surname on the storecard it related too, she never rang to change it as she always paid the bill etc and the card is shut down now. Her bank has refused to cash the cheque due to the mis-spelling, is there anything she can do? She did put a covering letter in with the reply slip explaining, but the cheque has been issued with the mis spelt name.
  • Contact CPP and explain. The cheque will have to be re-issued.

    Telephoned CPP - I was told that they received claim on 27th August therefore I should hear from them by 26th October - hope so!

    Received £281 for post 2005 from CPP who advised me who originally sold me the policy and when. Contacted Lloyds banking group, using the MSE template letter, and 2 weeks later received £150 from Bank of Scotland for premiums 1992 - 2005.

  • I made a claim and received a refund of my policy costs from 2005, a couple of months ago. Success!
    Returning from holiday yesterday I find an even larger cheque which apparently was all my premiums paid from 1992, when I first subscribed until 2005. I didn't apply for this so what is going on?

    I wrote to Marks and Spencer about pre 2005 CPP and I included all the correspondence I had to help outline my complaint about why I felt I had been mis sold their insurance. Received a letter from them rejecting my complaint so sent details to Ombudsman. The Financial Ombudsman has now contacted me stating that they cannot help because FCA handbook rules prevent them from going back as far as 1992? I have not contacted the Financial Ombudsman yet-thought I would see if anyone has any suggestions? I don't intend to give in easily because like millions of more people I do not want to feel that the big banks have won again!

    Please explain, you are contradicting yourself. FOS doesn't contact consumers unless they get in touch in the first place.

    Any CPP sold by Marks and Spencer pre January 2005 was not regulated and so the Financial Ombudsman has no jurisdiction. There is no point contacting the Financial Ombudsman.

    Hi, I contacted the Financial Ombudsman seven months ago outlining my complaint against Marks and Spencer Card Safe CPP pre 2005.
    I received a reply from them several days ago (email) to say that they were unable to proceed with my pre 2005 complaint as the FCA handbook didn't give them jurisdiction to do so. I haven't responded to their email yet as I wanted to ask people in a similar situation what they had done.
    The FOS stated that General Insurance Standards Council regulated 2001-2005 and I looked on the internet and found that previous to GISC the Association of British Insurers regulated. On the Financial Ombudsman's website it states that there are similarities between the standards set by all of the three regulators.
    I initially contacted the bank (M and S) that sold me the CPP prior to 2005 and when my complaint was rejected I used the advice and information given on this and other websites to contact the Ombudsman.
    I then waited 7 months to be told that they (FOS) have no jurisdiction to do anything about my pre 2005 complaint! Why are people being advised to contact first their bank and then if rejected the Ombudsman regarding pre 2005 complaints if this is the case?
    I would be grateful for any help or advice-thanks!

    Complainants are only being advised to do that if their complaint is with one of the financial institutions which were regulated prior to 2005.

    Your "bank" was Marks & Spencer who were clearly NOT regulated prior to January 2005. When you originally complained, M&S will have told you this and also given no permission for you to approach the Financial Ombudsman.

    The reason you have waited all this time is that you ignored what you were told and tried to refer your complaint to FOS regardless. The queue at FOS is very long and it has taken them all this time for someone to look at your case and realise that you never had any access to the Ombudsman in the first place.

    Basically, your complaint was over when M&S declined to uphold it months ago.

    There really is no point in you responding to the E-Mail you have received from FOS. You have nowhere realistically to go, unless you fancy going to court which is not recommended.

    It doesn't matter, Marks & Spencer were not regulated prior to January 2005 so any complaint from an earlier period can be rejected on that basis alone.

    Fish26 has already been rejected on that basis and has even tried to get the Ombudsman to overturn this but has clearly been unsuccessful.
