MSE News: Were you mis-sold an iPhone 5? Your options...

  • I am not a luddite, but I know very little about network spectrums, and I *specifically* asked the person in the Vodafone shop 12 months ago if my iPhone 5 would be compatible with 4G when it came to Vodafone. I was assured that it would.

    At the time I bought it, only EE had 4G. I explained that I wanted a 12-month contract - which was expensive - for the sole reason that when my contract was up I would own a 4G-capable handset and could shop the market for a decent SIM-only 4G plan.

    I was sold the phone by someone who was either negligent or a liar.
  • I don't really understand the lack of sympathy on this forum re this subject. I'm not accusing anyone of passing off baked beans as steak. When I bought my iphone5 a year ago, I asked if I would be able to use it with 4g, if and when 4g finally came to my area. I was told that I could. I'm not technical person but had been aware that 4g was faster than 3g, and that there was a lot of fuss about EE being offered 4g before the other networks. I wanted to be sure, having spent so much on the iphone5, that I would be able to move on to 4g when available. It certainly did not occur to me to ask for this in writing.

    As per MSE advice, I will taking it up with the retailer-- and beyond if necessary. Will report back.

    Well done! Would be good to see the emails to demonstrate your approach and how it was proven.

    Having worked in mobile retail I can remember correcting colleagues as they happily told customers how the iP5 would work on all networks with 4g. There was no intention to lie - they just weren't aware of the phone's limitation.

    Plenty of people will have asked the question "will it work on voda/o2 4g?" and they will have relied on the answer given from the salesperson. For those persons mis-sold I hope they get some kind of redress.

    Just to bump this, last September I bought a 24 month iphone 5 contract on Vodafone through phones4u, I was specifically told that when Vodafone rolled 4g out I would receive 4g.

    I have since been back in the shop and the salesman I spoke to said he had had 'loads' of people in the same boat come back in in the last few months. I didn't even have to argue, he was well aware of what had happened.

    He spoke to customer services and they weren't willing to do anything, so I spoke to them myself and made a complaint. They have now agreed that they mis sold the contract and have offered me a iPhone 5c free of charge as it's 4g compatible. However, I still won't be able to receive 4g unless I pay more each month.

    The only reason I got the phone in the first place was to get 4g. On my contract which I still have it clearly says '4g - YES'. Would you fight it further?

    For anybody interested, I did fight it further. I got a 4g tariff with brand new iPhone 5c and £25 credit all at no extra cost.

    Did you get a completely new tariff or did they just give you a new handset etc?? I am currently in the process of complaining about this exact thing to O2. After their recent price rises I'm not happy about not having 4G, AND paying a bucketload extra for international calls. I have lodged my case with Ofcom but am waiting to hear if they will take the case on.

    Hi in the same dilemma with o2 and their shocking price hikes, service, promises and coverage or should I say lack of, did OFCOM take up your woes?
