    This is getting beyond madness looking at waits of up to nine month how the hell are people supposed to cope. I'm looking at getting to three lots of treatments each week costing £20 in bus fairs alone with only £15 a week to live on as it is. Guess I'm going to have gone under long before it even hits assesment stage, even then it'll probably be turned down.

    I would strongly consider asking for compensation, if you are finally granted PIP.

    At a minimum, this would be the entire amount of busfare, if you would have been entitled to a bus-pass.

    Well. It just gets worse. Turns out there was a mistake made when entering points I was awarded and I am not getting enhanced daily living, I am getting the standard rate and that's why the payment was recalled.

    I am furious. I think I will appeal this decision, I believe I should be getting both care and mobility but was going to let it lie with the enhanced living however I am now, finally, after a 6+ months wait, under the care of a psych and will ask him when I see him if he'll support me in an appeal.

    What a joke.

    I think the whole thing is a complete shambles. If this was for any other sort of benefit people would be on the streets protesting. The problem is that Atos won't accept responsibility as the clip that Ian posted shows, and the DWP can't do anything until they get the stuff back from Atos. Have you tried your MP??

    My MP wouldn't be able to do anything at this point, I have to just go through the process and that process is to now appeal. Customer services (not the PIP bods) have been incredibly helpful and she agrees the assessment process is still flawed for hidden and fluctuating conditions. My psych even made a comment about my being assessed by a physio so I think he will be supportive.

    At least I've been awarded something so appealing becomes more of a point than a necessity as I am at least financially able to manage now if nothing else.

    Have you had a second letter, saying that you are only entitled to standard rate?
    Did you have a first letter saying you were entitled to enhanced rate?

    It is legal for them to do this (though see the compensation link I posted earlier in the thread), but only if they properly notify you of the standard rate decision.
    Otherwise, legally, you remain on the enhanced rate.

    Apparently there's a new letter on the way out. I did get a first letter with the enhanced decision so I'll wait and see if the second one gets sent.

    Please do 925dancer even in principle its also for the sake of others in a similar scenario. Obviously the more pressure we can put on them and their failings the more they can possibly improve the way they do things in the future (if not now) fingers crossed.

    I have to really think about it. Due to me claiming for mental health it could exacerbate my condition, the application process certainly did. I've noticed a marked improvement in my general mood since I had a decision and I have to consider if the risk is worth it. I want to fight for others but I do have to keep myself well and alive in the process.
