Hi,
I received an email with "evidence" from Excel in it.
One of the images shows the KFC sign I already posted which only says about the 15 minutes, another is a wide shot showing the KFC area without any signs in. But the remainder of the images are of other areas of the Peele Centre, not near KFC, with its P&D machines.
Are POPLA likely to be fooled by these out of context pictures?
I would indeed send an email or quick follow up letter to POPLA and state what your comments are about the misleading evidence pictures. Basically, am I right in saying that the entrance signs don't actually mention the KFC area, only the Pay and Display part of the car park?
If so, IMHO, there is no contract formed with a driver as a result of the entrance signs, when that driver is only using the car park to access the KFC. The rules are different around the KFC area and if Excel want to enforce PCNs there then they need an appropriate sign there with full t&cs, over and above the '15 minutes' one. Excel cannot expect drivers to guess any consequences of exceeding the 15 minutes, which could easily be caused by queues or delays with the chips in KFC!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

ASAP - POPLA is catching up with their backlog and cases are coming forward in the diary. They are contacting some checking whether there is any more information as they are about to make a decision (earlier than estimated). I don't know if you want to make use of the recent letter from PE where they admit that their "GPEOL" (in their view!!) is only £53, not £100?

Here's my mail I sent to refute their 'evidence'.
Good evening,
I would like to point out that the 'evidence' provided by the parking company Excel, is entirely out of context. None of the signs shown in the images are visible around the KFC establishment or noticeable for the driver while driving safely and as such are irrelevant.
Therefore I submit that this deliberate misrepresentation of the truth demonstrates the lack of sufficient viable evidence and POPLA should allow the appeal.

Interesting thing happened yesterday.
I was with my mum at the Peele Centre and the machine only returned 30p of the £1.30 it took - wouldn't accept her reg so she cancelled it.
Rang the help line number and someone answered eventually asking what the problem was, explained about the machine and then could not understand a word they were saying, so I asked if they could put someone on who could speak proper clear English and then they managed to say something clearly and said something like "You can go back in the queue and wait for someone who can speak proper English" in a really sarcastic tone and hung up!
Luckily I asked in Argos and they pointed us to the unmarked shiny building in the corner of the car park and spoke to the guy in there who got the £1 back and said he'd ring them about our complaint about the phone operator's rudeness (who knows if he did).0 -
I got a reply from Popla today. I won!

If I'm honest I was initially worried that you wouldn't make this, but as things progressed and you started to get to grips with it all, I became more confident that you would nail it.
