  • Let me see:
    • A OP comes onto this forum and asks a question
    • Gets answer X from general consensus of forum
    • OP comes back saying (elswhere on) the internet says answer is Y
    • Forum asks where this other answer came from
    • OP fails to provide a definitive link to where answer Y came from
    • Forum is sceptical, as they have not seen the alternative "evidence" which a simple URL from the OP would provide
    • Insults are hurled in all directions
    I wonder why.

Insults have not been hurled in all directions. Twonk, tool etc are not terms on this thread used by me. And your asking me to justify my answer to my question? To what end? I have my answer, if someone els has the same problem ill post a reply but i aint gonna reply to meself. No need to wonder why, it is massively simple:i sought an answer, got an answer, no longer require answer.

My company car policy says this ...
    Charges and Fines
Company vehicle drivers are responsible for paying all parking, speeding or other fines. Such fines must not be left unpaid as this will result in the authorities taking action against the Company. The Company will deduct any fines or penalties direct from the employee’s salary.

I queried this via Fleet (external company) and the response (from the Lease company) was ...
"The fine rules are set up that we pay all fines. Speeding Fines and fixed penalty notices are represented to the driver."

This didn't address the specific question I asked regarding PPC invoices. I followed this up with our internal Fleet Leader but have not yet received any response. (This is a good memory jog for me to chase them up).

The advice posted in this thread (about deductions being invalid for non-fines) is correct, but the difficulty would be in getting this properly handled to allow the driver to enforce their legal rights to appeal any such invoices.

In your case, bod1467, your t&cs do NOT cover invoices from private companies, this wording is clear:

''Company vehicle drivers are responsible for paying all parking, speeding or other fines. Such fines must not be left unpaid as this will result in the authorities taking action against the Company. The Company will deduct any fines or penalties direct from the employee’s salary. ''

A fake PCN from a PPC isn't a fine, isn't a penalty and isn't from an authority. For them to pay a private invoice when they would have ZERO liability simply by passing on the driver's name and address, is unfair and not supported by the employment/car use t&cs at all.

It's also completely DAFT to just pay private invoices from any old firm who happen to have mentioned the car reg and have headed notepaper! Anyone with a colour printer could print such a letter and make a fortune from idiotic Fleet Managers!
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I am always this rude to people that say they help when really they do not, if anything hinder. Always. My question has not been answered by anyone except me and my reasearch elsewhere. I conceed good points have been made and guidence given but the answer has not. To those people im gratefull for their effort. How much more do i want? The chuffing answer. Thought that was obvious. And as for learning to type, this is a skill i possess. However im blessed with small smartphone and fat fingers so your point there is mute too. But well done for trying.

I gave you the answer previously, you are asking for people's advice on contract of employment issues, we are not experienced in that, I suggest that if you are not happy with the answers here go and pay someone to give you the answers you seek
    Stroma wrote: »
You need to look at what your contract of employment says, and the company policy on their fleet is. We can't offer advice on the first, the second I would say that that involves fines, penalties and congestion charges, this is none of these.

Can I just say that if its not on any employment documents, they would be making an unlawful deduction from your salary. You need to educate your fleet manager on this scam. And you need to make a decision on how to handle this.
When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.
