In a word yes, for rerg 261/2004. Your flight was cancelled at short notice (< 7days) and not due to extraordinary circumstances.

It is worth starting here https://forums.moneysavingexpert.com/discussion/5173888
whether compensation is due will depend on the reason for the delay..was this due to strikes?
  • Could not believe the post on Saturday morning. I have hounded Jet2 on at least 3 separate occasions in the last 3 years requesting compensation for a 19 hour delay in 2012. Each time I have been fobbed off and only 6 weeks ago was turned down once again. Saturday morning cheque turned up for £872 - 400 Euros X 3 of us. Something must be happening!

I was on a Norwegian flight from JFK to LGW recently. The flight was delayed and eventually cancelled and replaced by another plane leaving 24 hours later, operated by Hi-Fly (Portuguese). The replacement flight was then delayed by another ~3.5 hours at least.

Norwegian is not in the EU, are they still under this regulation as an EEA country? If not, does the fact that a Portuguese charter airline (who, btw, presented themselves as "Norwegian" throughout the flight) operated the flight make them responsible? Many thanks for any advice.

I believ Norwegian are still obliged under reg 261/2004 but I stand to be corrected. If not then you have another bite of the cherry with Hi-Fly (depending on the arrangments between Norwegian and Hi-Fly)
And it all depends on a) the reason for the cancellation intially,b) the reason for the 3.5 hour delay, but note I think it has to be 4hours delay for that distance. Read Vauban's guide.

they are correct as the strikes were not within their control....have you tried your travel insurance to see what they cover for delays?

Used the documentation provided by MSE. I contacted the flightoperator directly who instantly dismissed my claim so I then contacted the CAAwho took up my case and I received the following emails snippets from CAA andThomas Cook.

    CAA

A full investigation has been carried out to find out whatthe cause of the delay was and under EU Regulation 261/2004 compensation ispayable on this occasion.

    Thomas Cook

I have arranged for a voucher to the value of £580.00 to besent to you to use on your next holiday. This equates to €400 per person asoutlined in the Regulation. This payment is in full and final settlement foreveryone on your booking.

Regulation EC261/2004 specifies that the compensation shallbe paid as monetary compensation or with the signed agreement of the passengerin travel vouchers and/or other services.

I sent the above regulation to Thomas Cook who then decidedto settle in cash.

Cannot thank MSE enough what a result.
