Can you ask the small claims court to delay a hearing until the plaintiff has had a reply from the AUC?Posts are not advice and must not be relied upon.0

Hi All
I recently booked my flight back from Spain to London Luton. When i arrived at Gibraltar airport to catch my flight home the weather was awful, the flight was cancelled and we were told that they would put on coaches to take us the 2 hour journey to Malaga. We sat there for 7 hours waiting for our coaches!! We were offered nothing, we were told nothing either. The communication was appauling. My partner asked at about 12.30 how long the coaches would be and he was told 2 hours, we eventually left the airport at 6pm!!! Do you think i can claim compensation???Freemans = £450, Alliance & Leicester Overdraft £275.00, Vanquis Credit card = £850  Second job = £200 per month.0 -
Hello All,
I am newly registered to this forum and am looking for some advice on a cancelled easyjet flight returning home from my holiday in Cyprus. I have spoken to easyjet and they say as they supplied transport to and from the airport with overnight accommodation we can only claim for additional parking charges and any food/drink we purchased in the airport. Is this correct? Also am I entitled to claim for loss of earnings as I had to take a day off work due to the cancellation?
My flight number was EZY 8808 and it was due to fly @ 22:20 on the 24/09/2010, in the end we flew home the following day on fight EZY 9808 on the 25/09/2010 @ 15:00.
The apparent reason for the cancellation was due to a medical emergency on board incoming flight and it being diverted to Munich.
Many Thanks0 -

Airlines are usually obliged to pay a fixed sum of money for a cancellation as compensation, in addition to providing care (food, hotel, telephone calls) to stranded passengers. However, if the cancellation results from "extraordinary circumstances" then no compensation is due.
I don't know whether a medical emergency is considered to be "exceptional circumstances" but I would imagine so. In which case, you would need to produce evidence that they are lying about the reason in order to get compensation.
If they are telling the truth, it sounds as if they handled this well and did what they were required to do.0 -
Do you think airlines should have some sort of standby aircraft and crew to operate your flight within a reasonable time when situations like this arise?Posts are not advice and must not be relied upon.0

I was travelling (on business) recently, on Thai airways from heathrow - sydney via bangkok and back
I was due to leave london at 1215, and had a 2 hour layover in BKK. The flight out was delayed by 4 hours, causing me to miss connection. To be fair, thai airways gave me a meal voucher in lhr, and then put me up in a hotel "day room" on the airport in BKK for 7 hours whilst waiting for the evening flight.
I finally arrived in Syd on the saturday morning, rather than the friday night orignally planned. (but given i was coming home sunday at midday, this made quite a difference)
I was travelling with hand luggage only, so didnt have any luggage delay issues, and i suffered NO fiscal loss whatsoever.
However, reading forums etc, It looks like there MIGHT be a statutory compensation for such a delay.
PLEASE dont pontificate about how short the trip was, i just want facts on what (if anything) the 12 hour late arrival is recompensable . No problem if not, the company paid for my accomodation, but it did throw my entire night out !!!
looking forward to hearing from the sages here....0 -
Is an ATC work to rule the same as an ATC strike? Is one an ordinary circumstance and the latter extraordinary?Posts are not advice and must not be relied upon.0

check out article 11543012 on the bbc website for a freeze on all claims in the UK
and I was about to file a claim against Virgin Airlines in response to their pathetic 'extroadinary circumstances' defence for what appears to be a routine pre flight maintenence problem.
Why can't airlines accept that passenges should not be losing a day of their hard earned holiday because of poor contingency planning for technical failures (either get it fixed or have a back up aircraft!).0 -
I will get you the date and flight number. The flight was the same plane the following day with a brand new number. I guess they will try and argue it was a delay rather than a cancellation?0

I flew on BA285 LHR to SFO on 29th of September. The flight was delayed by 10 hours due to various problems with two different aircraft. We missed a whole day of our holiday in San Francisco due to this. I called BA yesterday to see if we were entitled to anything and they said no, but from reading the link above we could be entitled to 600 euros each?
What would be the next action if BA have said we aren't due anything?0
