    A few weeks ago I emailed my local MEP (chose the Liberal as they are the most pro Europe), got a really supportive reply, she (Fiona Hall MEP) knows there is a problem, and has written with some success on behalf of constituents . Cannot do it for me as my case as I already have legal proceedings underway.
    She has previously written to the European Commission regarding companies who breach reg 261/2004, and following my email is tabling another question to request an update from the Commission on the situation.

    However, even the new proposals need some beefing up. I will probably be proposing amendments.

  • Ask yourself the question "What precise reason has the airline provided for the delay to my flight?"

    Lots of waffle but no clarity. The Regulation states that the airline must prove that "extraordinary circumstances" caused the delay to your flight but I see little actual proof, do you.

    If you want to receive your compensation, then I would issue a Notice or Letter before Action, giving the airline a choice of providing proof of ECs or paying the compensation due. Failure to respond to either or an invalid reason to deny the compensation owed would lead to issuing a legal claim without further notice.

    Hello I have just read this post and I received the exact same letter from Jet 2 with the exact same wording. Our flight had to turn around over the Bay of Bisquay in August 2009 because the air conditioning stopped working, this lead to a delay of approx 5 hours, I wrote to Jet2 and the replied with the mirror image letter of the gentlemans post above. Would you advise I write a letter as per your advice to the other person centepede?

  • Myself and partner were delayed for 4 hours on the 7/10/2011 from Egypt but don't have any paperwork left only a tag from our luggage and passport stamps can I still claim .?
  • Would I be right in assuming that if an airline has gone into administration then any hope of compensation is lost?
    I was delayed over 18 hours by Strategic Airlines last year due to a door fault. They weren't interested at providing any compensation at the time, and I have heard they went into administration later in 2012 having been dropped by Olympic Holidays.
    Or perhaps there is some sort of fund I could claim against instead?

    Thanks Jonathan. I sometimes need early reminders that i've got better things to do than to trawl several threads in the hope that there will be a new question, rather than one that has been answered for getting on for more than ONE THOUSAND TIMES :D

    There are FAQ's (sticky) to help you with these sort of questions. Please feel free to ask again is there's something not in these FAQ's that Centipede, myself, and a good few others, have taken several hours to compose for the sole purpose of aiding people.

    Apologies if I have put this question in the wrong area of the forum but i've had a look about and I can't seem to find the information anywhere.

    I recently had a flight from Glasgow to Auckland booked using budgetair.co.uk.

    All flights were on the same E-ticket

    The British Airways Glasgow to Heathrow (Terminal 5) leg was Supposed to be 1955-2115

    Then China Southern flight left at 2235.

    When I got to glasgow the BA flight was listed as leaving at 2005 and due to land at 2125 leaving me 1h10mins to get from T4 to T5.

    As you've no doubt worked out my flight was late landing and I got round to T4 at 2220 to see my flight reversing out of the gate.

    There was noone from China southern at the gate to advise me so I went back to BA in Terminal 5.

    BA claim that they have no fault whatsoever as the flights were booked inside their minimum transfer time between T5 and T4 of 1hr45 mins.

    I was left at Heathrow with no other option than to book myself into a hotel as the agent didnt open their phonelines till 8am so had to pay 140 pounds for this.

    When I phoned them in the mornin claimed that they were not at fault but would book me on that evenings flight 24 hours later than planned. They also said they would look in to the incident and get back to me but it's been a week and I've heard nothing.

    I was just wondering if anyone could tell me what my rights regarding refund of my hotel room and compensation are?

    Also, they say that they only accept complaints by mail, is this allowed?

    As long as you can identify the flight and were actually on it, the airline will not really be able to deny your claim, so go ahead!

    The FAQs on page 1 of that thread are a good place to start.

    BA are responsible for reimbursing your hotel/meals costs incurred during the wait for your re-routed flight but you will need to send copies of your receipts to them at this address:

    United Kingdom




    BA are also responsible for paying you 600 euros per passenger compensation for the 24hr delay in reaching your final destination as long as the entire journey was on a single PNR or reservation number.

    The airline may have a defence of extraordinary circumstances but this applies to only a limited range of reasons.

    Post back here if you receive the usual fob off from BA.

    Complaints can be posted as well as emailed...

  • Hi I need to email my letter to Germanwings but the email address I have is [EMAIL="kontakt@germanwings.com"]kontakt@germanwings.com[/EMAIL] which hasn't actually been acknowledged. I could post the letter if I have to but to send it recorded etc is going to cost about £35 which I am reluctant to pay unless absolutely necessary. If anyone has any advice I would greatly appreciate it :)
