    If the delay was within the airlines control and after 2005 then you should be able to make a claim
    If they refuse the claim, even though valid, and the flight was before 2007 then there is little you can do as you need to commence court proceedings within 6 years

    Just checked and it was Sept 2006

    Guess if they refuse then I am screwed! but worth a try i guess.

  • Need some advice if possible please:

    Flight to Hong Kong was delayed in January for over 36 hours due to a fuel leak, wrote to Cathay Pacific soon after, who said while the judgement was still pending they would be unable to pay

    When the judgement finally happened i wrote to them again, and received a bog standard reply that they were investigating my claim.

    1 month later I wrote to them again demanding the compensation and stating that if i dont hear from them after 14 days i would go to the small claims court.

    14 days later i used the money claim online website to raise a small claims against them for the compensation, interest, and court fees.

    3 days after this was issued Cathay Pacific wrote to me offering me the compensation only.

    I wrote back straight away stating that i want the compensation, interest, and court fees, and a few days after they wrote me another letter stating that they are only willing to pay the compensation and nothing else, and that the reason it took so long for this to happen is because they needed time to investigate my claim.

    What do you think i should do? I'm tempted to just take it to the next stage and let the court decide as its not my fault they took so long to reply and i think over 1 month is more than adequate. Especially as it seems the only reason they decided to offer me the compensation was because i went to the small claims, funny how 3 days after i do that they suddenly offer the money.

    Any advice?

    How much will you "lose" if they don't pay the interest and court fee?

    Weigh that up against a further delay if you go to court.

    Also (supposedly) the court looks to see if you have made all efforts to try to resolve the case (and therefore not waste it's time) so refusing to accept the (free:cool: ) money from Cathay because you want more of it ;) may not look to good IMHO.

    Your call really. You have done well to get them to pay up before going to court - my MCOL was submitted November and just spoken to the Court and they say hearing in March at the earliest. It would appear you have good grounds but it always depends on what side of the bed the DJ gets out of but there again where else can you get 8% interest! I think I would write back and ask for the compensation + court fee and as a compromise you will drop the interest charges (I have assumed January 2012).
  • By accepting the offer from Cathay I would lose the £60 it cost to raise case on money claim online.

    If i go to court there is a chance to get that back, plus some interest.

    I dont know why it took cathay so long to reply to any of my original letters, and it was only after i issued the court documents did they write to me very quickly.

    You really think that a judge would consider it bad to want more because Cathay have delayed the compensation? You could be right, but im just not sure

    Thats a very good idea, I will write back and offer to drop the interest charges and just request the compensation and court fee.

    Then if they still refuse I can take it to a hearing for the interest as well.

    At least that way it looks like i've tried to compromise

    Received the Thomson forms today.

    Bit concerned about the wording:
    "The form needs to be completed in full, inaccurate or incorrectly completed forms will be returned to you."

    My issue is they ask stupid questions like what time did you check in. Or when did you hear of the delay?

    Do you think they will wait 56 days then tell me I was wrong by 10 minutes on my guestimate of when I checked it?
  • Would love to know if there have been any successful claimants of Thomas Cook on here?

    Am sending my letter off tomorrow. Not holding my breath tho lol.
