Well it's all about opinions. The wording on the ECJ ruling (link in the FAQ's posted on page 214) is that technical problems are not EC's. But it goes further to say that it will be up to each court hearing to listen to the facts presented and decide whether they are beyond the airlines control.
The way I read the ECJ judgement is that this type of problem certainly is within the normal running of a airline, and it is within the airlines control to fix the problem.
So IMO you need to write back to Virgin and state that you do not agree with their summisation of the problem, and ask them to reconsider.
If they decline you are then faced with the option of leaving it, or issuing a court claim against them. Expect them to defend if that's the case and prepare (read, read, and read again) accordingly.

Thank you for your reply Mark much appreciated. Have been reading this thread from start and preparing a reply to Virgin's response. I don't agree with their reason as previous poster states, various differing reasons were given for delay. Also my understanding from this thread is that these were not EC.

GB airways with GT flight numbers - contact easyJet

First choice airways - contact Thomson

  • Does anyone have any experience of claiming with Ryanair? I sent a complaint letter following the flight in 2009, which was ignored but it does seem I have a claim as flight was just delayed due to previous flight being delayed. Will complain again via website but would love to know of any Ryanair success stories.

  • Martin, thank you for your Proforma that we used to claim compensation of £800 for 4 passengers who had a flight cancelled 2 years ago from Manchester to Glasgow. I should say I am not one who normally believes in the compensation culture but this time we did. We were going on holiday for 2 weeks and had to fly with FlyBe from Glasgow to Manchester to pick up our flight for our 14 nights holiday.. FlyBe originally changed our return flight with 15 days notice ( the day before we went on holiday)which meant we had to book and stay 2 extra nights etc at Manchester and when we complained we were told by Flybe ' we follow the rules' - so no compensation for added costs. On our return from holiday we went to get our return flight to Glasgow ...There was then a long delay and then cancellation of our return flight & we complained to them in writing and they wrote back citing ' sorry, technical problem'. We kept this letter thankfully and we sent this as evidence, with the Proforma claiming compensation, and they wrote back within 2 weeks offering either £200 cash per person OR £300 FlyBe vouchers per person!:rotfl:

Does anyone have any experience of claiming with EasyJet? I have written to them using the template and reasserting a claim I'd originally made for a 3hr delay 2 years ago however they've not responded or even acknowledged - does anyone have a follow up letter template or advice?

We had a delayed flight with Thomson, they responded before the judgement denying the claim.

Afterwards I sent a LBA but this was received and ignored (no acknowledgement letter or silly forms sent).

I now want to take them to court via Moneyclaim.

We have sent all the correspondence in the lead passengers name (My Mum). (There were 3 passengers in total)

However now it has come to court I would prefer to issue the claim in my name, to avoid any extra hassle for my Mum.

Can I do this straight away, or would it be better to send another LBA in my name this time?

    Thanks!

You can issue the action in your name, although it might be prudent to have a letter of consent from your mum, as lead passenger, to you taking up the reins on her and other passengers behalf. IMO you would also inform the airline of this for the avoidance of doubt.

You are out of time to make a legal claim if your flight was in 2005.

There was a flurry of out of time questions recently, I didn't reply to all individually, I just reposted the FAQ's.

Hopefully Blindman will pop in before long and update his Faq's to include Richard's recent asks for addition, there have also been some more success stories since to add to the list.
