  • I have just received an email from BA to say that they will be paying compensation for a delayed flight - more than 24 hours to Miami in 2009, however there were 3 passengers (0ne a teenager) and the compensation they have offered is 1200 euros, am I missing something? I have replied to say that we paid the full fare for our son and they have confirmed with us that there were 3 passengers so why are they not compensating all 3 of us, has anyone else had this from them? By the way I got the response today, I wrote to them in October - they signed for the letter on 26th October, so all those out there waiting for a reply from BA it is a case of being patient.:)
  • Thats encouraging! I first emailed BA at the end of October and heard nothing despite sending two email reminders and a letter. I sent an NBA which they received on 4 december. On monday this week after still hearing nothing i rang them. Guess what, a case was opened on 4 December and i can expect to hear from someone by 18 december, the day my 14 day NBA expires, coincidence or what? I think i have a cast iron claim but we shall see...

Thomas Cook are hopeless making all sorts of excuses up. I asked them to explain what a FAC 1 fault is, they informed me that they will have to go back to their airline. & it will take another 28 days. delay tactics

This is yet another "fob off" excuse, I have also heard Thomson use this as an excuse not to pay compensation
    .
A FAC1 fault can not be considered "extraordinary circumstances"
There are 2 FAC's on an aircraft - when FAC1 fails, FAC2 takes over.

Each FAC interfaces with the elevator aileron computers (ELACs) when the APs are disengaged, or with the FMGS when at least one AP is engaged. Both FACs engage automatically at power-up.
The pilot can disengage or reset each FAC (in case of failure) by means of a pushbutton on the flight control overhead panel.
When a FAC is disengaged (FAC pushbutton set off) but still valid, the Flight Envelope Function of the FAC remains active.
If both FACs are valid, FAC 1 controls the yaw damper, turn coordination, rudder trim, and rudder travel limit, and FAC 2 is in standby.
FAC 1 keeps the aircraft within the flight envelope through FD1 ; FAC 2 performs this function through FD2.
If a failure is detected on any channel of FAC 1, FAC 2 takes over the corresponding channel.
  • Hello all, I am new to the site so forgive me if I'm doing something wrong :) I was delayed for over 24 hours on the way back from Gran Canaria but the airline we used was Flyjet which has now ceased trading - does this mean I cannot claim for any compensation?
    Many thanks for your help.

    You are correct.
    AIRLINE BUST = NO CLAIM

SilverJet acquired FlyJet in October 2006
but they also suffered suspension of operations on 30 May 2008

Has any one had a reply from Monarch Airlines. I sent a letter on 9th November 2012 + have not even had an acknowledgement

My flight was delayed 5+ hours on 7 Oct 12. I wrote to them by email and snail mail, using the draft letter on this forum, on 9 Oct. On 29 Oct they sent me a claim form by email.
This claim form was obviously an initial draft, as a more fuller one came out to other claimants about 2 weeks later. Nonetheless, I completed it and sent it off, with all the documentation asked for, by recorded delivery on 31 Oct. I emailed them about 2 weeks later asking for them to confirm receipt of my claim, and documentation, and asking for a time frame for settlement. About 2 weeks later they replied, confirming receipt, didn't answer the time frame question, but did say that they were inundated with claims.
They also confirmed that there was an operational problem with the plane and that they had to supply two smaller planes.
One was on time and my one was 5 + hours late.
So it appears cut and dried really.
But no answers or any correspondance whatsoever.

I've decided to let things develop and observe any other claims being reported, I will send a NBA early part of new year if no response, and will issue MCOL 2 weeks after that if so.
By then, another poster on here will have had a case come before a judge, so my intentions might well be adapted to suit.

Did they mention Sturgeon before you started the small claim process?

I mentioned it and they denied liability for "delay". They stuck to that, so I issued a claim in court. They then applied to stay the claim, based on the ongoing ECJ action.

    Hi,
This has probably been answered already but I just couldn't find it on the forum.
My Ryanair flight was delayed by nearly 5 hours. I've got the template from this site and would be grateful if someone could advise me to what postal or email address it needs to be sent. I've checked their website but the only postal/email address I found there was their postal address in Ireland.
    Many thanks.

Did you know that it was likely that they'd apply to stay the claim?
