  • We have got a claim in with virgin for a 7.5 hour delay to cuba. They have responded individually to the two claimants (have to fill in a form per person) and have said they will investigate but it could take 6-10 weeks. Another delaying tactic. Not going to forget about it!!

    I sent an e-mail early November to British Airways about a flight delay last June. It was a BMI baby flight (BA took them over).
    I got the standard - your complaint is being dealt with reply.
    Sent another e-mail 10 days later as nothing had happened.
    I then sent a recorded delivery letter stating all of the details - as outlined in the template from here on 26th November stating that I would like some sort of reply within 10 days.
    Nothing has been forthcoming.
    Anyone any ideas as to what to do next?

  • With reefrence to #2016,#2187,#3285,& #3345, pages 101,110,165,168 respectively. I have now received a defence statement from Iberia's solicitors acting, being one day late for the 28 days allowed by the court, but dated for the actual final day. The defence have claimed that the plane suffered a hard landing, and claimed extraordinary circumstances. However in my initial legal claim 6/1/2011, the document stated if they reject my claim on extraordinary circumstances they should furnish the specific reasons. They rejected my claim based on a technical issue, that Could have affected safety. I challenged them on that, and requested the exact specific details, in five parts i),ii),iii),iv),& v), leaving no get outs. They sent a 2nd statement ignoring the request, just repeating the prevoius statement, and not providing the requested details, but they were not claiming Extraordinary circumstanes at that time. They failed to respond to many letters, and a year latter, December 2011, another response received, where it was stated it was a technical iisue, that could affect safety, but stated the plane arrived late at GRU, a new turn, claiming extraordinary circumstances. And two years latter in their defecnce, they now claim a heavy landing at GRU Brazil, and extraordinary circumstances. What a farce. But in the two year period the AESA, Spanish regulator asked Iberia for all the details, investigated it, and stated no extrordinary circumstances exist, they should pay us 2 x 600 euros, and pay us compensation for non compliance with the Montreal convention. basically upheld fully may claim. So I am awaiting the final court papers to pay the hearing fee £110, in my case, and a Court hearing date. The solictors defence for Iberia is a total denial of everything? Even my MEP could not get anywhere with Iberia.

    I will keep this forum informed of my progress.

  • I got a reply from Singapore airlines yesterday saying that my claim has been rejected because the flight was more than two years ago and they referred to 'Article 35 of the Montreal Convention'. Does anyone know what this is?

    You can levy an 8% interest charge if you make a claim via the Court process. The interest is applied from the date you incurred the delay.
  • Hi,

    I have a claim in progress with Thomas Cook for delays to Cyprus and back. I didnt have any booking documentation, my emails had been deleted, and I did not have a booking reference, however with some persistance, I have managed to obtain my booking reference from Thomas Cook and it appears that they have recognised that I was a passenger on the planes I have quoted.

    I will update on my progress however its some good news for people who are put off by claiming if they do not have any proof that they were on the planes.
