    Every chance IMO.
Silly question, but how. Isn't it my word against theirs? Any suggested argument?

BLL was your final destination and remained as such, notwithstanding that BA re-routed you to CPH. The fact that they reimbursed your rail ticket from CPH-BLL merely underlines that they know they are liable for this under the Reg so this was not a goodwill gesture, whatever they might claim.

They didn't claim anything, I asked if they would be willing to reimburse my train ticket and they agreed. This was all weather related by the way so no compensation would have been due either way. My point was just that when I, as the passenger, requests rerouting to an alternative airport and the airline agrees as a goodwill gesture, it seems to me clear that I thereby effectively agree to change my destination airport. BA were prepared to fly me to my original destination, though it would have meant a night in a hotel in London and arrival a day late. Legal aspects aside, going after the airline for compensation in such a case on the grounds that they failed to get me to my original destination in time falls in the "!!!!!! move" category IMO.
  • Good afternoon, I first contacted Thomsonfly 5 weeks ago re compensation. They told me I would hear something within 4 weeks. This is now going into the 5th week and I have just rng them only to be told it could take up to 6 months for legal matters. Is this correct? Is there a time limit in which they should respond by? Thanks. Lorraine.
  • Hi. This is my first post ever! so here goes!
After having our flight from Tampa back to Gatwick with British Airways in April delayed by 38 hrs we were put up in a hotel at Tampa and then given meal vouchers and reimbursed some of our expenses.
After hearing about the ruling regarding compensation, I wrote to BA 3 weeks ago asking for compensation and enclosing copies of the booking, boarding tickets and letters that they had sent us apologising for the delay.
I am quite annoyed that BA haven't even bothered to reply to my letter which I know that they received as I sent it recorded delivery. What would be the next step?

Used the MSE template letter to re-open a complaint (delayed BA flights 2007, original complaint 2008) that had been closed without any compensation. BA reply received within a week: requested compensation agreed!!! THANK YOU MSE!
  • I was delayed on 4th Feb this year flying out of Heathrow due to the snow. I sat on the plane for 7 hours taxiing to the runway and back for deicing, just discovered this forum and it looks like I can get a refund for the flight as I arrived in Bangkok over a day late, being re-routed via Singapore. No compensation as it was outside of the airline's control, but a refund would help the cost of my next trip to Asia. I'll report back on the success/failure of my claim.

Seeing that BA are one of the airlines that have started paying out without too much fuss, I would hang on for a couple of weeks before making enquiries as to why no answer has yet been received.

Hi all today i have received this reply from Wizz air so i have asked for evidence it could be a common response travelling to East European distinations but this was in Summer !
With regards to your claim we would like to draw your attention that the reason for the flight delay was rotation delay picked up during the aircraft’s previous stops resulting from London Luton airport incompatible with the operation (bad weather conditions).

Please consider that Wizz Air as operating air carrier shall not be obliged to pay compensation, if cancellation or long delay is caused by extraordinary circumstances according to Art. 5. par. (3) of Regulation (EC) No 261/2004 of the European Parliament and of the council establishing common rules on compensation and assistance to passengers in the event of denied boarding and of cancellation or long delay of flights.

Originally Art.5. par. (3) of the Regulation applies to flight cancellations but the European Court of Justice in its judgments concerning compensations for long delays of flights extended the application of Art.5. par. (3), stating that the airline shall not pay compensation for long delays, if the long delay was caused by extraordinary circumstances which could not have been avoided even if all reasonable measures had been taken.

We would like to inform you that according to the operative EC regulation and our General Conditions of Carriage, in case of a flight delay we are willing to reimburse your expenses occured directly due to the delay such as meals, refreshments and two brief telephone calls can be reimbursed in reasonable relation to the waiting time upon reception of supplementing invoices.

As for the additional expenses, we kindly ask you to forward all related invoices, as an attachment to your reply, so that we can determine a possible compensation and please send us the further information:

    - IBAN

Where was your flight departure from? It's quite possible to have fog at Luton in the summer. But it doesn't delay for too long normally.
