Compensation for delayed flights Discussion Area

It's very important for potential claimants to act entirely reasonably and not give the airline any slight opportunity whatsoever to say 'unreasonable' conduct.Posts are not advice and must not be relied upon.0

But...my Air France flight from Johannesburg to Birmingham (via Paris) in November last year was delayed by 10 hours. I was in a hurry to get back so accepted a seat on a South Afrrican Airlines flight to Heathrow instead. My wife drove around 100 miles to pick me up. Would this qualify for a compensation claim? Advice gratefully accepted.
Were you delayed for more than 3 hours when arriving at LHR? In either case it's a tricky one since AF are likely to argue that their responsibilities ended once you accepted re-routing with a different carrier and you'll have no valid claim against SAA since they aren't a community carrier.0 -
I sent them a claim letter on 7th November and also chased it via their website last week but havent had a response.
Has anyone else made a claim against them?
Thanks0 -
Does anyone know what happens if you had a delay with an airline that is no longer trading. We flew to Egypt from Bristol in July 2010 with Kiss Flights and had a very long delay. Kiss Flights ceased trading in August the same year. Can we claim compensation and/or refund from someone else?0

You are honestly having a laugh here...SERIOUSLY
READ even back 2 pages and you'll read, quite clearly
"Airline bust = no claim"

I know the thread is long but it's still a good idea to read back even a couple of pages to see if your question, which you know has probably been asked before, has been answered! (which, by the way, it has several times)
Sorry for the tone of message but seriously why can nobody read previous messages‽‽‽‽‽‽‽‽‽‽‽‽‽‽‽‽‽‽‽0 -
Part of the reason that this thread is so long is due to the repeated questions.
I'll take it upon myself to copy Blindman's all encompassing FAQ's for the good of the forum.FAQ's
Answers to FAQ's repeated AGAIN  All blue words are links to relevant posts. Some are quoted just to save you doing that
WARNING
Claiming may not be a walk in the park. So research this (long) thread and the MSE article in order to discover useful information before you ask a question!

New to all this, but I am now going to claim against Monarch for a six hour delay to a flight from Birmingham to Rome in April.

Much will depend on how this came about. More info please.
But at the least, over 5 hr delay, you're entitled to a refund.
Check out the CAA advice about your rights... although you will be chasing through the French version of the CAA.

Hi, does anyone have any idea how to contact Skywings? We were delayed on our flight from Skiathos to LGW for 8 hours due to a fault with the plane door. We were abandoned in the airport overnight with no means of food or drink (although that was the fault of Olympic). I have emailed Skywings (It's a Greek email address) but have had no reply. I don't even know whether the recipient is able to read English!! I can't seem to find any address/email for a UK based person.....any ideas????
Thanks in advanceCentipede100 wrote: »As you have discovered there is no UK address and you will have to correspond with their Greek address. You also have the issue of trying to convince the airline to settle your claim which is unlikely unless you can get them into court!
OK, thanks. So far I have emailed the office in Greece but have had no reply. I guess I go on to wrote to the same office, unless anyone has any other ideas?!?! From what you have said, Centipede100, it seems like it may be futile, but I guess I may as well try?!?!

I'm not sure what you are trying to establish.
The point of the post, at 3756, is to show up that the CAA are only listing the 6 items that you have posted above, whereas Monarch have introduced their own version of what the CAA say. Monarch have added items that are not true, in an attempt, IMO, to put people off claiming.
The ECJ ruling is saying, regarding Extraordinary Circumstances, that the breakdown, or failure, of a working part of an aircraft, is not an extraordinary circumstance, because it is within the airlines control, to fix the problem. (and to get it fixed and on your way quicker)
Whereas the airline can't be held to be in control of the problem, if it is something like 6 inches of snow on a runway, forcing the airport authority to close the runways.
Hope this helps,
Mark
Have you got a link to the exact ECJ page that says that?0
