  • What you need to gather to make your claim is your boarding passes or reservation number/PNR, flight number and date and these details can then be edited into the CAA template letter and forwarded to the airline. If the airline has already written to you stating that the reason for the delay is due to crew shortage then you have a prima facie case for compensation due to the delay.

    If the reason was given verbally or via a third party, your claim letter will need to include something along the lines of "please settle my claim in full or provide me with your full defence to my claim within 14 days of the date of this letter or I shall commence legal proceedings without further notice."

    You do not need evidence as it is for the airline to prove their defence not for you to prove your claim - reverse burden of proof in cases involving 261/2004.

    I doubt we still have boarding passes but I have the reservation number (not sure what PNR is?), flight number, date etc so will check out that PDF link.

    They never wrote to us, we were just told that the delay was crew shortage when we eventually took off (by the crew).

    Will let you know how we get on!

  • I have got the flight dealy times from the checker with the scheduled time and leaving and flight number. It was First Choice and from my relcollection I think there was an aeroplane fault.

    In 2011, we had a delayed flight from Paris to Leeds. I checked the flight stats website. Theres only one flight from Paris to Leeds that comes up that day (19th Feb 2011). It says it was schedules to leave at 8.30pm but left at 10.07pm.


    I checked my email because I still have the confirmation email from Jet2. It says the flight was meant to leave at 14.15. I remember we were there from about 10am, and it was nighttime when we got back - about 9 or 10pm.

    So flightStats is not very accurate it seems. It is the same flight number on their website and in my email. I hope the airline doesn't use it to check though!

    hi registered wiv flight stats but cant seem to find our virgin flight from mco to man in june 2010 when we were delayed by 4/5 hours also if it was a technical problem ie air con not working would we beable to claim ???thanx
  • Hi Fellow MSE-ers,

    I flew with MyTravel from Gatwick to Sanford on a very delayed flight in July 2005.

    My flight is not showing up on the Flightstats website, so I can't check exactly how long the delay was, but I believe it was over three hours.

    MyTravel has ceased to operate flights under that name, but still operates under the Thomas Cook brand.

    Does anybody know if I can put in a claim and, if so, who with!? MyTravel still exists as a tour operator, or should I claim through Thomas Cook?

  • Hi,
    In September I booked a return flight to the USA from Manchester. The flight was booked with Iberia and I was given an Iberia flight number (I later found out there was a flight code share with Iberia, American Airlines and BA and the flight was actually operated by American Airlines). The flight on the way back was cancelled and we were re-routed the following day to London via British Airways. I have sent a letter to Iberia but they have replied saying I need to contact the airline who operated the flight.

    If you want to pursue what appears to be a valid claim, you should issue a Notice before Action followed by legal proceedings or hand your claim over to a claims handling company to pursue on your behalf.

    You have 6 years from the date of delay to commence legal proceedings in the UK.

    Again, thank you. Could you tell me what a Notice before Action is? When you say legal proceedings, do you mean the small claims court? I'm not very good at all this due to my Autism. :(

  • Can anyone clarify -
    If the flights were a "one world" code share - i.e. flight from Madrid to Lima with Iberia flight number but operated by LAN (Chillian airlines) - who do I send the compensation letter to?

  • With 3 unserviceable toilets, the aircraft would have to offload passengers.

    If it was a Boeing 767, it probably has 4 toilets for the Ecomony Class to use. So maybe a ratio of 50:1. Take away 3 toilets, you would force 150 people to walk forward into Premium or you could offload them.

    The passengers never even got onboard. My sister and I flew to AMS from ABZ and when we got to AMS I switched my phone on to receive a text message to say that the flight was delayed. What was originally a 1 hour connection became over a 3 hour connection of wandering the terminal, sitting at the gate and waiting to board.
