Michael Oleary was on the BBC 1 news pro gramme this am and it was put to him almost the same situation as yours, and he told the person to write to him and he would issue a full refund...
I would include in the letter " as per your quote on BBC 1 on 31/10/2012 an delay of that time compensation is due"...
you can see it on Iplayer if you want ... good luck... he claims his flights are the cheapest anywhere, he forgets that you ahve to include all the add ons for them...
he also claimed that Ryanair is the only airline to give a 10 kg hand luggage allowance!!!...lol

My own claim has now gone off to Monarch...including the boarding passes
:). they have been given 14 days to pay before court action....

Thank you for writing to us regarding the flight delay on TCX7473.Naturally I was sorry to learn that you experienced the delay.
Tour Operators and airlines do work very hard to ensure flights leave on time, however, factors outside of our control can occasionally affect departure times. Some common examples are weather conditions, unavoidable operational circumstances or the sheer volume of air traffic.
All of our customers are protected by the new Air Passenger Rights obligations, which were introduced in 2004. This dictates what welfare arrangements the airline have to make available if delays extend beyond a certain period. Full details of these are displayed around the airport terminal buildings, and I can see that these were complied with.
Unfortunately, there is no provision within legislation within the Airline Industry for Thomas Cook to make compensation payments if a flight is delayed. It is because of this that insurance companies usually make some provision within their policies. Therefore, the insurance provider would be accountable for any such outlays and not Thomas Cook.
I would like to thank you for taking the time and trouble to write to us and I trust this clarifies our position.

I would write back quoting parts of the regulation (261/2004) which are relevant to you. Or just send a copy of the whole thing, and then ask them to explain why they have lied. I am waiting for a reply from thomas cook myself. Did you write to the bradford office?0 -

I have just sent of an email to the legal company of my home insurers as I am hopefully covered by legal assistance for which I pay an extra £7 per year for on my buildings and contents policy.
Our Monarch flight to Goa was delayed for 12hrs and 10 minutes in November 2010 due to the plane having to divert to the Azores on the way to Gatwick due to "technical reasons" They then had to send out engineers and spare parts to repair the plane before it could pick us up at Gatwick.
They gave us a letter whilst we waited for the plane confirming in writing that the plane had technical problems followed by a letter in the post when we got home also saying the same.
I just hope that the house insurance legal policy covers us for such claims, as there is always "small print" on these policies.;)

The more I read, the more confused I get.
" If a flight is cancelled, or delayed by over 5 hours, you are entitled to your money back for the ticket cost, or re-routing if the flight is cancelled. (re-routing does'nt apply for delays.) plus meals, and accommodation in some cases." This quote from MSE newsletter 24/10/12.
In July 2007 twelve (12) of us were booked to fly from Gatwick to Dalaman at 10.50 am, the flight was delayed and eventually flew at 22.27 pm. (TCX 718) We were ferried to a nearby hotel and refreshments and meals were available and chairs to sit on (no bedrooms, shower or changing facilities) Although we were not told officially we heard stories that pilots were on strike after Thomas Cook had taken over another airline. Strikes are one of the get out clauses for paying compensation, but the way I read it is that we may still be entitled to a refund. Can anyone shed any light on this for me please.0 -

I have never claimed anything because didn't know until last week that I may be entitled to refund. All I have is flight numer and passenger names,and yes it was to Bodrum on 23/07/2007 like I said I'm very confused right now.0 -

firstly, thanks to all those who have already posted regarding their experiences and given advices, they helped me getting in the picture before I start my own claim:beer:
A few months ago I got my flight with Wizzair delayed by about 10 hours and I am now seeking compensation for the delay and the poorly handled situation, so I'd like to ask a few questions.
1) Has anyone claimed compensation with Wizzair yet? With which results? Which address should I send the letter to? The Hungarian registered address?
2) I read from the Moneysaving post:
"If a flight is cancelled, or delayed by over five hours, you are entitled to your money back for the ticket cost, or re-routing if the flight has been cancelled (re-routing doesn't apply to delays), plus meals and accommodation in some cases. You're also entitled to compensation of up to €600, which you can get on top of a refund for the ticket cost."
Is this correct? Some answers I've seen in the forum seem to contradict this post. My guess: does the post mean that you are entitled to renounce to the flight and get the full cost of the ticket back, but if you actually take the flight that doesn't apply?
3) Should I get a negative reply from Wizzair (as I expect, after the few replies I have read of in the forum), what's the next move? I am seeking €500 compensation and I don't know what cost to expect from a legal proceeding to the small claim court.
