  • After writing a letter to Cathay Pacific on 24th October, i've received a reply already:

    "Cathay Pacific is very mindful of the judgment published by the European Court of Justice on 23rd October relating to airline obligations under EC Regulation 261/2004 in respect of flight delays. We are considering that judgment carefully in the context of the distruption to your flight on 28th January 2012 and we will revert to you shortly"

    I assume this is a bog standard letter that they already had prepared and are sending to anyone who asks for compensation.

    How much time should i give them before writing to them again and/or going to the small claims court?

    So there is no need to send a LBA letter then, my claim will suffice?

    If they have not replied within the time limit set out within the letter you sent them, then yes, as long as they have signed for it to prove they have received it

    Yes it was sent recorded delivery, I have noticed any emails you attach a delivery and read receipt to they no longer accept....

    Ok will start working on the court paperwork

    I think it is a generous offer too to be honest if you only arrived an hour later than scheduled. We had a 7.5 hour delay with US Airways from Manchester to Philadelphia in May which caused problems with an onward flight to Seattle. The flight arrived at Philadelphia 7 hours late. We were re-routed the next day (night spent in flea pit hotel) on a flight going via Phoenix which resulted in us losing a hotel reservation and a pre-booked ferry to Vancouver Island.

    We have had an almost exact email from them and an offer of $600 flight voucher each. We don't intend to accept this and are putting together a reply today.
  • Fudeit85's question just made me realize that I did not put a deadline at the end of the letter which centipede100 kindly posted a couple of times. How much time should I give BA to reply before turning up the heat? The claim was submitted via their website on the 24th.
    CAA replied that I will hear back from them within 2 weeks, but I guess this will be wishful thinking after the ECJ ruling.

  • Hi, hoping someone could shed some light on the level of compensation I should seek... On Sep 12th 2012 my flight from LDN to MIA was delayed which meant I missed my connection from MIA to GUA. It was due to a technical fault on the rear door. Virgin gave me a hotel and meal vouchers as I had to spend the night in Miami so I could catch my flight to Guatemala the next day.

    I have complained to Virgin and they have offered 4000 flying club miles- looking at their website it will be years until I can make use of these. Should I be pushing back for more compensation or is it a lost cause? I do have a return flight next May from MIA to LDN so was thinking trying to get an upgrade? Any help would be appreciated!
  • I'm new to the forum after hearing about the new ruling of compensation on flight delays. I'm just wondering if anyone can tell me if I'm likely to have a claim as the delay was in 2008?

    We, myself and my 2 children were due to return home to Manchester from Reus airport on flight TCX211 at 20.20 23rd June 2008. Briefly, the flight was cancelled & after lots of uncertainty & waiting around we ended up being transferred by coach to Barcelona airport. After lots more waiting around and only being offered a voucher for a sandwich (which was awful I may add) & a drink we eventually boarded a First Choice aircraft (which was only being used for the Reus passangers) at 6am 24th June after enduring nearly a ten hour delay!
    I have no paperwork from then & didn't make a complaint at the time. I was just happy for us to finally get home.
    Can I make a compensation claim now this new ruling has come in on 23rd October?

    Got a reply from the claims unit!!!

    Hi,

    Thank you for your completed claim forms. However the cover letter does state that any adult passenger over the age of 16 needs to complete and sign their own form.

    I have attached another form for you.

    Please make sure all 3 forms are signed by each passenger.

    Am a little confused as it was 1 booking and not 3 separate bookings, all names are on the original paperwork and filled in a claim form and put all 3 names on it, also included all 3 names in my letter...also included the boarding cards ( copies)...

    My thinking this is another prevarication tactic by Monarch, I will fill in for the other 2 and email back....

    Does this mean as they are insisting on 3 separate claim form that the court claim will have to be 3 separate claims as well?

  • I have no proof as it was so long ago. I'm annoyed with myself for not complaining at the time!!!
