I would say that's a breach of contraact, their mistake, they pay for it.
You bought the tickets in good faith.
Did you poay with credit card? If so a Section 75 claim maybe possible.
They refunded the fees albeit almost 2 months later. I am not sure what the claim under Section 75 is possible.

If I would make a mistake in a booking and cancel the booking 4 days later will I also be able to get away with it?

did you book direct with BA or through a third party?
  • Claim under S75 is the same as against the airline so if the airline isn't liable beyond refunding the money, neither will be the credit card company.

    Third party
    What difference does it make?

Because with a third party you make a booking request and your correspondence should’ve with your chosen third party
What do the third party t&cs state about errors?
From recollection last time the error fare was not found on the BA website but was advertised by certain third parties

Do you know if there was ever a ticket issued or just a booking made?
you made a booking request to purchase ticket for £x
the agent will ring fence the funds from your card and make the booking with the airline
If the live fare is the same as your booking request value, the ticket can be paid for and issued
bookings will have a 'ticket by' (pay) date before they will be auto-cancelled
if the live fare is more than the advertised fare one of three things generally happens
    1) agent contacts asking for more money, you pay or your hold will drop from your card in a few days
    2) they state there was some sort of card / security issue that meant they could not make a booking
    3) they do nothing (no notification after confirmation of booking request) and it is up to you to notice that you have no booking any more (some people find out at the airport)
If you want to search your agent on TripAdvisor Air Travel forum, you may see a pattern
  • Many thanks.
Will do and will send the CAA copies as well as I still have the reference details and e-mail addresses.

Yes it was ticketed ie I had a ticket number. I checked my booking on the airlines site and it was there for about 3 days and then disappeared. When I queried the airline they claimed it was a mistake in their pricing and therefore they cancelled.

Most airlines have a clause in their T&C that allows them to cancel error fares. It's not really something that's covered by EU261.
