    Return journey was non EU airline from non EU airport so no compensation under reg 261/2004. Only what UA might be willing to give you as goodwill, if anything.

    However, experience would suggest UA may attempt to limit your compensation to a single payment.
    Lets hope not as it has been established by the EU that 2 lots of compensation are due.

  • Thank you very much for the advice I have received. United have responded very quickly offering us two lots of EUR 600 each & $125 each for the Newark to Edinburgh delay. Happy days all round. Thanks again especially for the link to Vauban's guide.

  • Hi all,

    I've had a claim rejected by British Airways for a 4-5 hour delay on a flight to Venice at the end of July. They cited "extraordinary circumstances" which I expected they would, and seems to be airlines' go-to response to avoid taking responsibility.

    However, I don't consider a rainstorm "extraordinary circumstances", especially given my friends who has delays and cancellations during the Beast from the East all got compensation, which seemed a much more extraordinary circumstance. What worries me is that the company MSE tells me I have to go through for BA, is called CEDR, which apparently charges £25 for failed compensation claims. This seems very sneaky from BA, because it means they can refuse all compensation, then dissuade people from challenging for fear of being charged extra money.

    Seems bonkers that I can get compensation for a 30 minute train delay, regardless of cause, but can't get compensation for a 4-5 hour plane delay because it was raining (weather which I'm sure BA has to deal with daily, worldwide).

    What are my options? Go to the CAA? Many thanks in advance.

    the test would be whether the delay is fully within the airline's control, which weather, and the associated ATC restrictions are not
    Which airlines did your friends receive compensation from re Beast from the East? (it was a clear EC)
    Have you put your flight details and date in EUClaim and bottonline to see whether they believe there is a case?

    If the flight concerned was cancelled as a direct consequence of bad weather (e.g. a rainstorm) the regulations are clear that it counts as extraordinary circumstances. If it was a knock-on effect, things are less clear.



    BA does not refuse all compensation IME.

    Has anyone had any luck with Pakistan International Airlines (PIA)?

    My flight was cancelled and re-booked for the following day, which I assume goes under the +4 hours delay category, with a right to compensation of up to 600 euros

    I've just submitted my case through Resolver, so fingers crossed something comes of this...PIA is the worst airline ive flown with, every time there's a delay, I hope they pay out, unethical !!!!!!s

    I would always do it myself. The cancellation has to be caused by extraordinary circumstances to be eligible for compensation, just so you know.
