Just a quick update for you:
Part i) the Enforcement Team have confirmed that the bailiffs have returned the case to the CSA as they didnt get anywhere with visiting my ex, they did even query the address with me and I confirmed that it is indeed his home address as the children (well, child, one goes, the other refuses to visit as the house is yukky) visit him there. They said the case will now be looked at again in case they can freeze his bank account or if he has any other assets (he doesnt) then they will looking at committal procedures. what would happen if at this stage he panicked and made an offer of something like £20 a month off the arrears, would this halt any further action from the CSA or has it gone too far for that?
Part ii) My complaint is still with the CSA, I had a reply from my contact at the CSA to say

In respect of the arrears - they are now working towards a steer to get all the arrears paid off within 2 years, which he won't be able to do, so they should be taking enforcement action and rejecting twenty quid a month in order to force it through the courts - ask them if they would do this rather than face the possibility of it being stopped again. At least if it goes to Court they can set an amount for him to pay which if he defaults on they can go back again for a Show Cause hearing. It needs them to prepare a committal hearing first.0

Appears they are going for a third party debt order. I won't beat about the bush. It will probably be unsuccessful as I'm sure he will empty the dosh out of his b/account(s).
I can't remember whether he rents or owns his home. If he rents that's why they are going for committal proceedings and not charging orders. Look for Kelloggs experience regarding that.
If he came to an arrears agreement ( and you ain't consulted about that!:mad: ) then you start going through the painful procedure of going round in circles of 'pays for a few months, then defaults, back to enforcement, pays etc'. My ex is an expert at it. Been doing it for years.And interest free too. Makes me sick.
I doubt the CSA will do as Kelloggs suggests and reject the 20 quid. Too much hassle for them.
I wish my arrears would be paid off in 2 years!

thanks for the replies. He doesnt have a bank account as he has such a bad credit history nobody will touch him. He is living with a girlfriend in her council house so has no property to sell any more, having already sold it a couple of years ago when he split with his then wife and he pocketed the proceeds as the CSA didnt think it necessary to apply for a charging order, preferring instead to go for the DEO which also proved unsuccessful! Obviously as the arrears are £28000 he wouldnt be able to pay it off over any short period of time, would the CSA accept any kind of payment plan off him as he has never paid anything at all in nearly 14 years, why would they trust him to stick to a payment plan at this late stage? Or wouldnt they?0

They cannot get money out of a man of straw. Looking back at your previous postings he has no job either. Has he signed on or is the girlfriend 'supporting' him?
Committal proceedings seem the way forward, but will you get any money?
My way of thinking, especially as you say the CSA botched up when they failed to put on a CO, is, your best bet is to go via their complaints dept and then the Parliamentary Ombudsman.
Let's see what your CSA contact comes up with at the end of the month.

Is it true in cases like this, they can't take any more than a certain percent of his income?
If so, i think that is disgraceful because the CSA is a debt - credit cards and loan companies can bleed people dry, but the CSA are !!!!!!.

He has no income as he is working unofficially for various mates! I dont know if he is signing on or not, but the CSA are still assessing him as working and he is supposed to be paying £107 a week, they said this will continue to be added to the arrears until he advises them that he isnt working.
He is living with a girlfrend who has 6 children and is having a 7th by him, I dont know if she is claiming as a single parent so she doesnt lose any of her benefits, I would imagine this is the case, as he is not on any official records as living at that same address.
I know I wont get any money even if he does go to prison, but that isnt the point anymore, I am hoping the complaints procedure will sort that side out re their !!!! up in not putting a CO on, I am requesting that the CSA pays me the amount that I would have received from the sale of the house as it was their fault they screwed this up, thereby denying me the one and only chance to collect any of this money owed to my children. this is why I have got my MP etc involved.
I used to think that I couldnt see him go to prison over this, now I have definately changed my tune, especially as he is having another child who will end up estranged from him with no support, I really would love for him to get his come uppance, gosh I sound really bitter dont I?!

TYPICAL do really think your x will pay that ammount of money? dont be silly furthermore you getting csa to send baliffs to his or her apartment to take stuff. after that you really think he will be willing to help you with the money side of things dont be silly. even if baliffs took his stuff they still would not rase the ammount of money you want at arction. if i was in you xs shoes i would have nothing to do with you and make sure you get nothing from me. you some how think he is not going through any bad situatoin with the csa and baliffs kicking down doors taking his stuff all becos of you. wome who do these type of suff make me sick get a job0
