    The law is lacking in this area to protect people in your situation.

    Why would it be the agent's fault? They are legally obliged to put forward any offers that are made through them. The decision to accept a higher offer is squarely with the vendor.
  • No they didn't say why, though I have just returned to work from maternity leave and have only had one pay cheque so far showing this- I have also changed Jobs (within the same company) and my pay has gone up. I had to provide my contract to prove it. Not sure if these are the reasons why....

    I was of the understanding that if it was off the market then that's that- no other offers accepted or even put forward to the vendor. Might be worth kicking up a stink- especially as you've already spent out on a survey. Could always threaten EA that you'll make local press aware- that'd put off any potential customers from viewing any of their properties!!!
    No. You may wish to have a look at the 1979 EA Act, which specifically requires Agents to communicate offers to vendors.

    The EA cannot prevent the potential purchaser making the offer, nor the vendor accepting it.

    In this case think "greedy vendor" as Agents tend to be happy when they have a sale and want it to complete quickly so they get paid.

    Where I am most EA activity is fixed fee, so an increased offer doesn't mean the Agent gets paid more...

    20/2 2nd viewing
    21/2 offer accepted
    21/2 AIP (I already had one but this mortgage was cheaper)
    25/2 full application submitted

  • After pulling out of a previous purchase due to problems with the road that the solicitor advised against we have now started the process on another property that we really like.

    Timeline so far

    6/2 1st Viewing
    7/2 2nd Viewing (we liked it that much and have looked at around 20 houses in total!)
    12/2 offer accepted
    16/2 AIP (already have an existing offer from previous purchase attempt but have found a better deal so applying for this)
    24/2 Application submitted with all requested documents
  • Thought I would join in!

    11/01/2015 - 1st viewing
    13/01/15 - 2nd viewing
    14/01/15 - offer made and rejected
    16/01/15 - 2nd offer made and accepted, broker meeting
    17/01/15 - DiP received from Abbey
    20/01/15 - Full application made.
    29/01/15 - Initial Mortgage offer received.
    30/01/15 - Valuation done
    3/2/15 - Full offer received. Survey booked plus solicitors on their merry way.

    6 weeks to go hopefully, chain free FTB.

    UPDATE:

    26/2/15 - Contracts exchanged. Completion date set for 19th March. 3 weeks of hopefully hearing nothing from solicitors!!
  • We have our mortgage offer in! Horray!!

    So it's taken exactly one week from application going in to valuation done and full offer confirmed- very impressed with the Halifax and my broker!!! Now we're just waiting for our buyers valuation- 3 weeks after we accepted her offer.....hurry up!!!

    Congratulations... Hopefully I am having the same to report in the next couple of days... Got our valuation report through today.. Hoping offer follows swiftly too..
