they made an order to have my MCOL hearing moved to another court, and it was granted, but still nowhere near them.

    Hi coolio,
do you have a date for the hearing? If yes, how long did it take from you filing the claim to getting a date assigned?

No date yet, just reassigned to another Court. I filed around the 20th August.
  • I'm thinking of taking a TMO contract purely as they are the only ones I can find to port to Voda and offer large cashbacks.

Looking at the T&C's they state:

11.2 If you have a 12 month contract in order to claim your Line Rental Entitlement (Cashback) you are required to do the following:
On Instalment Date 1 (120 days from and including the date of connection) send to us the Cashback Redemption Voucher Numbered 1 with a bill showing that you have been connected for a minimum of 120 days.
On Instalment Date 2 (210 days from and including the date of connection). Send to us the Cashback Redemption Voucher Numbered 2 with a bill showing that you have been connected for a minimum of 210 days.
On Instalment Date 3 (270 days from and including the date of connection). Send to us the Cashback Redemption Voucher Numbered 3 with a bill showing that you have been connected for a minimum of 270 days.
On Instalment Date 4 (330 days from and including the date of connection). Send to us the Cashback Redemption Voucher Numbered 4 with a bill showing that you have been connected for a minimum of 330 days.
On Instalment Date 5 (360 days from and including the date of connection). Send to us the Cashback Redemption Voucher Numbered 5 with a bill showing that you have been connected for a minimum of 360 days.

This sounds much clearer than sending numbered bills within 21 days etc.

11.4.2 claim each instalment of the Line Rental Entitlement (Cashback) Claim within 60 days of the relevant Instalment Date. If your claim is received outside this 60 day period, your cash back entitlement will be void.

Is this a relatively recent change to the 30 day rule that has caused so much grief on this forum?

Am I being naive or have TMO been forced into making their T&C's clearer and fairer to follow?

    quids in,

Are you sure you can port to Voda?

Have a read of the thread(It is evident that you haven't).

If you think it's simple after reading the thread, please explain it to me, i'd be grateful.

You have pointed out that they've changed their t's&c's again
will have to see what else they've taken the liberty to change.
Well life is harsh, hug me don't reject me.

I believe that The Mobile Outlet have made a few mistakes whilst trying to tighten up their criteria, too many people have claimed their money back correctly.

In tightening up their criteria, they've unwittingly outfoxed themselves.
Their terms are nigh on impossible to meet.

    The main problem is :

If The Mobile Outlet realise their mistake and honour failed cashbacks, they open the doors to all of their customers who fail to meet the new criteria. This will make their payout rate 100% , which is not what they projected to payout.

If they don't honour failed cashbacks, they will be submitting court papers more reguarly than they are at present. At £30 a pop plus paying out the cashback for the full term will put their cashflow in even more trouble.

*I believe a reputable company would rewrite the t's &c's with ones that can be met, and have an amnesty on the '1st August children'.

    *Expect them to soldier on.

I wrote this on the 16th Aug, I wonder if The Mobile Outlet have been reading this thread. ;)

  • Lol! Never ceases to amaze me how THE most disreputable companies STILL suck 'em in and spit 'em out! I'm sorry, but anyone getting a deal with this lot after they've had the opportunity to read this thread deserves the treatment they can look forward to!

I've read the full thread and others on TMO.

I certainly didn't mean to imply the T&C's are simple, just that 60 days is fairer than 30.

Whilst many people have had claims rejected for being late or incomplete that is in breach of the T&C's and unfortunately there's no arguement.

I do however appreciate that a great many people have issues with contractually correct claims and have had to resort to MCOL to get their money.

I have no doubt that I can make a correct claim and therefore if required would claim my money through MCOL. Nothing in this life is free or easy but it does seem that customers get their cash one way or the other.

Also, although the T&C's and the porting page on the TMO website say no ports to Voda or O2 there is an option to port to Voda during the ordering process. I would confirm this with TMO first if I was to order from them.

    mobilejunkie:
If TMO are disreputable I'm sure they're not alone. I've also read many bad things about phoneboxdirect and E2save as well as the plethora of other cashback sites.

Who would you recommend for a reputable cashback deal? I need to port preferably Voda but would consider Orange.

Mobileshop.com also port to Voda but their cashback isn't as competitive.

I am not posting this to engage in an argument with anyone and I'm certainly not pro-actively supporting TMO but I'm extremely limited in choice as most websites don't port to Voda. All advice is greatly appreciated and I have by no means decided to order from TMO.

I'm glad that you've read the thread, I bet it was interesting reading. :)

60 days is fairer, but 30 extra days does not scratch the suface of the 'sharp practice' that these lot get up to.

Rejected claims can still be reinstated even if you've incorrectly made a claim or sent late. I have explained this in the thread. Do you remember me talking about "Unfair contract terms/Plain English".

I can only recall 1 person receiving their cashback in the contracted time.

If you make a correct claim, you will get your cashback through reminders/LBA's and MCOL if they are still in business.
If you are confident that you understand their tricks and confident that they will still be around a year from now, go for it.

My experience tells me that porting to Voda won't work, but what do I know?

Getting a reply from The Mobile Outlet to a query is not something that i've had much luck with, I have had 1 response(that didn't answer my query) in my correspondence with them.
Well life is harsh, hug me don't reject me.
  • Now you've touched on my major concern that I meant to put in my last post.... Will they still be in business in a years time??????

Gut feeling would tell me to stay away from these guys, I was talking myself into it for the Voda port. I'll take your advice here too as you obviously have a wealth of TMO knowledge and I respect all your advice.

If I cast TMO out of the running do you have any recommendations for better cashbacks? O2 business upgrades suck and I've been with them for 20 years since the Cellnet days. I've looked at Simply3g but don't have any experience of 3 to know whther the network is OK or not let alone the deals.

Mobileshop.com do a Voda port but the offers aren't as keen.

I'll go off trolling other threads, I don't mean to cross contaminate other websites on the TMO thread but all suggestions are appreciated.
