Hi,
I sent my bills off for my 2nd cashback claim which were returned today b Royal Mail with the comment "The Addressee has gone away".
Maybe it was my neglect, but I was not following this thread on a daily basis so this talk about administration is totally new to me. I also did not hear anything from TMO indicating either a change in my T&C's orabout them being unable to fullfill their obligation under the cashback contract.
I would appreciate any advice from here. At the present time I am violating the contract, however at the same time I did not know they had moved/whatever or heard anything from them to indicate as such. Please bear in mind I live in Scotland and as such would need to do anything legal via the Scottish systems.

I doubt T-Mobile will allow a drop to £5 unless you were only on a low plan to begin with.
A frind of mine has spoken to them and after talking with a Manager went from Flext35 onto a U-Fix one for £20 but the minutes are pretty low, so you might end up paying more in the long run, so may be better on say FlexT25 (currently being discounted to £20).I didn't do it, nobody saw me do it, you can't prove a thing!

I will hold off for T-Mobile for the moment. If I do downgrade I'm then deliberately violating the TMO contract whereas at the moment I sent the stuff on time and in good faith with receipts to prove it. I'd like to see what if anything I can do to salvage my cashback (1st claim still owed to me) before calling it quits.

Yes, the whole point of administration is to try to keep the company going which cannot be done if it stops trading.
We haven't found any cashback contracts on there though.
For those who are confused about the difference between a company being in Administration and a company being in Receivership, there's a very good guide HERE, courtesy of PriceWaterhouseCooper:

Here are a couple of extracts from it. (The emphasis by colour is mine.)
"The administration procedure, first introduced in the Insolvency Act 1986 and substantially revised by the Enterprise Act 2002, is designed to hold a business together while plans are formed either to put in place a financial restructuring to rescue the company, or to sell the business and assets to produce a better result for creditors than a liquidation. Administration can also now be used where neither of these objectives can be achieved, simply as a mechanism to liquidate assets and distribute the proceeds to secured or preferential creditors, but this is not the primary purpose of the new law."
"Once a company is placed in administration it is protected. While rescue proposals are being prepared, no creditor can take steps (without the administrator’s agreement or the court’s permission) to disturb the business or recover any assets."

The first cashback claim went in in November and despite numerous requests I have had excuse after excuse. The latest trick seems to be holding callers on the 0871 number for as long as possible without saying anything although you can still hear the office sounds in the background.
I tried to email via MSE "forumqueries@themobileoutlet.co.uk" address and emails to them and claims department bounce back. Today they tell me they have a system down and I should wait 28 days for a resolution.
I have to send the second claim today so I expect that will disappear as well.0
