    It is important in this situation to separate the two issues involved.

    The first is your ordinary rights under the standard contract with the network which you and all the other customers who bought a ‘phone on that network that day entered into. You are perfectly entitled to insist on your rights, particularly if they are still being printed on the invoices they send you. (I find this amazing!)

    The second is any favourable treatment you feel you should receive as a result of what happened under your contract with Mobile Matters (U.K.) Ltd.

    For the reasons outlined in a previous posting, they are not amenable to admitting any wrongdoing by themselves in the affair; so, getting stroppy with them on that aspect of it will induce hostility and be counter-productive.

    Far more likely to succeed, and generate a sympathy conducive to getting what you want out of them on this issue, if you are not entitled to it under your T&Cs, is to adopt a disarming and rather sheepish “I’m afraid my circumstances have changed, through no fault of my own, and I need to downgrade my tariff - how can you help me?” approach.

    If it is presented to them that you can’t afford to continue the higher tariff and unless they will lower it you will simply have to cancel your Direct Debit (which would involve them incurring all the expense and hassle of pursuing you though the courts for money) whereas, if they lower the tariff you will be able to go on paying them money indefinitely and perhaps raise your tariff again when things get better for you, the latter option is more appealing to them. If they should extract, say, £250 out of you by forced action but lose you as a customer forever, and you then go off and pay one of their competitors £300 a year for the next ten years, it would be they who lose out - and they know it.

    on my first installment I received only £49 when I should have received £84 so I rang tmo and I was told that when I took the contract £35 was paid to you early as the first phone you had was faulty and you had to wait for a new one so it was a early redemption as good will.

    the third installment was paid but I had to email then twice and rang around 5 times before I received payment


    the forth installment I sent on the 24th November 2007 not received no payment


    the fifth installment I sent on the 27th December 207 and received no payment I have rang them many many times I have emailed them 6 times no reply
    I am so fed up I am waiting payment of £168 which is allot of money every time I ring them they have staff that are so dumb and stupid they can not stand plain English they gave me a number to ring 0845 450 2241 and I rang them up and they have nothing to do with the mobileoutlet please can someone tell me what action can I take?

  • Whilst they are a con and I advise people to avoid them, it is perfectly possible to get contracts and phones for nothing if you are dedicated in your investment of time, research and vigilance. For starters, don't pick the wrong company like this one - although that's just the start of a lot of care.

    I keep reading from people out of pocket by a lot of money, can anyone please tell me how they are more than £1,000 out of pocket?

    I don't recall TMO offering cashback deals for more than £50 per month, so how someone can be out by £2,400, I don't know? :confused:

    Depends how many contracts they have,maybe they are business phones.

    By taking multiple contracts from them.
