    Hi

I recently won a CCJ against TMO, they did fail to turn up in court (no suprise there) but did submit a written defence !

Only just discovered this thread so forgive me if I ask a repeat question, but as there as so many in my situation (or about to be) is it not possible to take some kind of joint action to wind up the company and recover all the outstanding debts ??

See Shelby's post on the previous page regarding this and the responses to his post.....

Thanks.......waiting on an answer to Taz63's question then

Really fed up about throwing good money after bad !!!
  • laticsforlife: I'm afraid you chose one of the all-time worse companies and should never have exposed yourself to such a liability with them - if any at all. It is nothing new at all for people to have great trouble getting money out of them even before this - that has been quite plain for years. If you don't understand what the risks or or the nature of the company you are dealing with it's really no use at all to complain now. I too lost a little with Mobile Affiliates BUT I fully recognised the risk of dealing with them, limited my exposure and mitigated the loss when they went under. Further, up until the last few months of their existence they (unlike this dealer) DID pay up without too many problems. Unlike most I did not once blame the dealer or rant at anyone; it was my choice, my risk and I (unlike many) went in with my eyes wide open. The only constructive and worthwhile thing in this situation is to see what you CAN do to mitigate the loss. Cashback deals are NOT for the faint-hearted, unwary or careless.

    I refer to my guide:-

Anyone doing the minimum amount of research on The Mobile Outlet even 2 years ago would have easily discovered how bad they always were. That is why I never went with them with even one deal even though the deals were very tempting.

Just spoken to the Baliffs office in Bradford. TMO have "seemed to have closed down their premises" (the one at the football ground) One of the directors was to have attended a meeting with the Baliffs office but didn't turn up (really suprising that !!) Their were about 100 enforcements outstanding at the mo...

If have repeated anything said earlier ...sorry

Doesn't look good does it ???

Personally, I wouldnt waste any more money trying to enforce judgements against Mobile Outlet.

They are a dead duck now, and you are extremely unlikely to receive a penny.

They have spoken with Trading Standards and advised them of their situation.

Just try and speak to the networks if you have been affected and see if you can get a discount, but they are tightening up on these claims, stating that it is between the Customer and the Dealer.

There has been a tough period over the past few months, with these companies going down, and there will be more to come, but there are not many left, to offer misleading deals, thankfully.

The Mobile Phone Credit Crunch has arrived, as in other industries, and lessons have been learned.

    I've been Money Tipped!

TMO are a victim of the models sold to them by unscrupulous networks in expecting only 40% of claims to be made - I think this rather foolish, and that the Networks should shoulder some of the blame but they are far too powerful for that.

Sorry you are about to lose a large amount of money, and yes it is easier to say, "Move on", but if you don't it will just eat you up!!!!!!!!!
I only lost a tad over £200 with CNM, so yes, a lot easier for me. But for that £200+ I had a 12 month contract, 400 mins per month etc., a brand new SE phone, so not too bad after all.

I don't agree at all about TMO being victims. TMO were in it for themselves to make as much cash as possible and were actually hoping they would NOT pay back all the cashbacks. It would be nice to be able to get out of a contract once the T&C's have been broken, hopefully something like this MAY happen in the future, who knows????

The one good thing is when they go bust, they won't be able to "fleece" any more customers!!!!!!!!!!!!!!!!!!!

    According to this article....

    http://www.mobiletoday.co.uk/Cashback_bill_reaches_25_million.html?terms=cashback&fragment=&SearchType=&terms=cashback

...TMO stopped trading in November! If that's the case why is their website still up and running?
