    Be wary of the Wayback site.

    It's very helpful but it gives a misleading impression of the dates upon which the T&Cs actually changed.

    Only rely on it for the content, not for the dates :A

    Been away for a short time! It has forced me to leave me pestering them about my 3rd Cashback claim!

    It has now been 48 days since they received my bills.

    Even by their emails that says that payment is running behind and that payment should be paid around 45 days!!! blah blah blah.....

    Well its allowed me to see if they pay-up without hounding them!
    Guess what........ NO PAYMENT :mad: :mad: :mad:

    Yes you can imagine I wasn't suprised!

    Email sent to Cashback team! Lets see the responce.

    4th Casback claim due in at the start of December.

    Are there any templates for the dispatch note/covering letter anywhere?
  • I sent paperwork for cashback recorded delivery within the 21 day timeframe, unfortunately due to postal strike delay my documents arrived after the 21 day time frame.

    mobile outlet finally sent me a letter after numerous communication that it arrived late and would not pay.

    while this went on they delayed my previous claim payment by 10 weeks and then finally paid but after 10 weeks after seeking help from this forum.

    Please advise as I have sent the paperwork within the 21 day timeframe I have proof of this. I have also given them reasonable timescale to receive the paperwork in this case sent within 15 days, 6 days to receive although they received after 11 days (26th day).

    Mobile outlet have breached contract first by making a late payment of 10 weeks

  • The best advice would be to read all of this thread. My mother is taking TMO to court after being in the same situation. When we looked at the T&Cs they did not say anything about bills being received within 21 days - the word they used was "forward" and she had done that well within 21 days

    Hi,

    I am waiting for my second cashback instalment from Mobile outlet for almost 3 months now. Numerous times I have been told that my cashback has been approved and would be paid "within 10 working days" - but it never happened. I sent LBA two weeks back asking them to pay up the second instalment (£84). Now I want to initiate small claims proceedings.

    However, I am thinking of putting a claim for the full outstanding cashback amount of £336 (because of breach of contract) - not just the one instalment. Can I do that (I have noticed some people in this forum has done it)? Do I need to send a new LBA as the last LBA mentioned only one instalment?

  • Hi, this is my first posting on this forum although I have been diligently following the thread!
    I have finished my contract with Vodafone which I bought from TMO.
    I opted to go paperless billing with Vodafone because I do everything online and didn't want to waste paper! This meant that after the first bill, all bills were online.

    My first 2 claims were accepted and paid out in which a mixture of Vodafone bills and internet printout bills were sent together in the first claim and the second claim consisted wholly of printout bills. TMO had no problems with those. They even paid within 21 days of receiving my bills!!!

    The problem started when my 3rd claim (bills 8&9) was sent and I received an email confirming the receipt more than a month later. Then on the following day a letter arrived which rejected the claim on the basis that the bills were copies not originals.

    I wrote a formal written complaint regarding this on 27 September and guess what, they have only just responded TODAY! Breach of their own T&C clause 8.0 which states that they will respond within 48 hours of complaint being made... Yeah right!

    What I would like to ask is -
    (1) Are internet printout bills copies or originals?
    Bearing in mind that TMO have accepted and paid the first two claims in whicn I sent in the same internet printout bills from Vodafone website!
    (2) If they are still refusing to pay (3 claims outstanding), can I file a Small Claim against them for all 3 claims? They have just ignored the other 2 claims I sent (4th and 5th claims). No acknowledgement of receipt nor any email regarding those claims. I think they have basically decided that the 3rd claim is wrong and so the remaining claims invalid also.

    Please help.
