Also...dont know whether to accept this and send LBA on Dec 11th when (most likely) payment has not arrived, or to just send LBA in a couple of days when they will be out of their 28 day stipulation as per the t&cs....any suggestions.

Personally, I would be tempted to send them an LBA 28 days after they received your claim. I am right in thinking that this is the timeframe TMO say to allow for payment in your T&Cs? My claim against TMO has recently been settled, though it does annoy me how they keep on coming out with all these excuses, that I read on this thread, as to why cash back will be paid late e.g. BACS problems etc. It is pretty obvious it's just a ploy to delay paying cash back. Even when I had to chase my first claim, at the beginning of this year, I got really fed up with the autoreply on their e-mail account, for example:

I received this e-mail reply several times, and needless to say they never responded within the timeframe they quoted in the e-mail, or replied with anything meaningful i.e. they never quoted anything specific to my claim, so I quickly got the impression that they were just sending me a standard response. If I had known then what I know now - regarding the legal process - I would've simply sent them an LBA, and would probably got my cash back a lot quicker than the 80+ days it took them to pay me. And my claim was 'successful'!0 -
Hi been trying to ring TMO but kept getting cut off. Tried today to hear they have a new number but when I tried to ring this, a woman on the other end of the phone said she keeps getting calls as they have given out the wrong number. i have been waiting since 9.9.07 for cashback. They are not answering e-mails either. Does anyone know if this company has folded.0

Hi, just to say panic over for the time being. I eventually found my Oct 2007 bill purely by chance, had used it as proof of ID and it was still in my backpack, the last place I looked. Sent today by Special, so hopefully something'll come of it.

I am still totally confused about what to do for my first claim, and TMO havent responded to my emails asking for confirmation.

You contracted, last August, of your own free will, to comply with the following condition:
“On Instalment Date 1 (120 days from and including the date of connection) send to us the Cashback Redemption Voucher Numbered 1 with a bill showing that you have been connected for a minimum of 120 days.”
Subsequent to the posting to which you refer, we established that your ‘phone was connected on 11 August 2007 and that your “Instalment Date 1” will be 5 December 2007.
You ask now whether you can discharge the above contractual commitment by submitting your bill dated 11 December 2007.
I presume (it is a reasonable presumption) that your bill dated 11 December 2007 will show merely the following:
1. That you paid your previous invoice.
2. That you made calls between mid-November and mid-December 2007.
3. That you are about to be charged line rental, in advance, for the period mid-December 2007 to mid-January 2008.
What aspect of this bill do you believe will make any mention whatsoever of August 2007 or show, in any way, “that you have been connected for a minimum of 120 days.”
It will show only that you were connected for the 30 days between mid-November and mid-December 2007.
So, just how do you propose to furnish, on “Instalment Date 1” (5 December 2007), The Mobile Outlet with “a bill showing that you have been connected for a minimum of 120 days”?
It appears finally to have dawned upon you that you have contracted to send to The Mobile Outlet, on (specifically) 5 December 2007, a document that you will be unable to supply and that you have agreed, furthermore, to forfeit the whole of your cashback entitlement if you fail to do it.
It was for this very reason that I commented that that your situation was going to become complicated...0 -
My sons 1 st claim was turned down in October and I sent a LBA ( many thanks for all who helped ) about 20 days ago. Should I now just go for court action or is it worth another e-mail or phone call?0

If they ignored your LBA, and you don't follow it by "action", then you just wasted your time on the LBA.
Firms like this thrive on customers "empty" threats.
Before you go for court action read the MCOL advice to claimants on "Will I get my money?"0 -
