Lol, inkypinky, 2 months is about right. Average waiting time for me is around 60-70 days. Luckily for them they've managed to pay up before I've sent my LBA but I've alway got it prepared. All I need to do is date and sign it and send it off. Btw, if this is your first cashback then you should just take them to court and claim the full amount of the cashback they owe you because they have breached the contract by not paying you within 28 days of receipt of cashback documents!0

This new number is a premium rate number and earner for them.
Hi all,
I have tried to find out the exact costs for this number, from the BT website, but cannot find this detail. However, a quick Google search indicates that 0871 numbers are charged at 10p per minute from a BT landline. (This does not take into account any call/price plans discounts a customer may receive, and this maybe cheaper at evenings or weekends).
Rather annoyingly, it appears that companies "can expect to receive up to 4p per minute by using this number". Which is not so bad if you're a company providing a service, e.g. technical support or recorded advice, but for a customer trying to find out why his cash back payment is 2 months late, this is a different matter, especially if they keep you on hold.
Send them an LBA and be done with it!
You will save the call costs and may get you cash back quicker, since TMO will see that you mean business.
If you don't want to weigh in straightaway with an LBA, send them an e-mail instead of phoning this revenue generating 0871 number.0 -
I filed with small claims end of August, paid £50 in court fees. Just had a letter asking for another £50, apparantly you also have to pay for a hearing fee as well as the initial £50 now as well. So £100 just for the court to consider my case. And 5 months to get a hearing, so in all that time I will have received most of my cashback anyway after chasing forever.0
-
The hearing fee gets added onto your claim, and will be paid by the Defendant if you win.
But, in August, when you took out the claim, there was a different fee structure - your fee paid then covered the cost of a hearing if it was needed.
(Now the initial fee for a claim between £300 and £500 is only £35 (via MCOL), with the £50 hearing fee you have been asked for now only payable should a hearing be necessary)
You posted earlier that the court had messed up your case due to an "admin error", so maybe your hearing should not incur this new £50 charge.
If you are confident of your case, then maybe its easier and less hassle to just pay it in the knowledge it adds to the costs payable by the Defendant??
As always, bear in mind though that if you win and the Defendant can't pay it's a hollow victory. One can never guarantee that a Defendant has the funds to pay a court order when the time comes.0 -
i recently sent back my allocation form, & it stated that a £50 fee applies if your claim is over £500.0
-
Yes, the hearing fees do now apply (£50 for claims £301 to £500, £75 for £501 to £1000 and sliding fees for higher sums).
But in August there were no hearing fees to pay - you just paid one fee on issuing the claim which covered a hearing if one was needed.
The new fee for issuing the claim alone is (a little) lower than it was in August.0 -
I'm just angry that 1) when I applied it said £50, it didn't mention another £50 down the line, and 2) the hearing was delayed due to their incompetance, but then I do believe it would have been after 1st October anyway.
I'm more angry at Point 1 as you cannot rope someone into a system and keep demanding more money and not lay it out from the get go.
I am claiming for the whole amount, but cashback in the meantime has been paid, and as some people have just received 1 cashback through the courts, I don't want to shell out £100 and be told 'they paid didn't they? What's your issue? and I'm £100 out of pocket, numerous special delivery letters paid for, and lost wages.
Allocation Questionnaire was sent in early Sept.0 -
The courts admitted to you their error in wrongly closing your case.
Maybe a letter of complaint to the court asking they refund the original fee you paid, explaining that due to their mistake you feel your case has been dented by the Defendant making a part payment in the long period that has elapsed.
And if this fails - then maybe a LBA to the court!!0 -
Hi,
The Mobile Outlet still owe me for three lots of cashback (about £210).
I've been desperately trying to get in touch with them, but they don't seem to answer emails or pick up the phone.
I'm ringing them on 0871 427 3500, is this the correct number?
Also does anyone have any advice on what to do next?
Thanks0 -
