    After telling me on the phone 2 weeks ago that I would receive a bacs payment within 10 days, and suprise suprise i havent got one, a different person on email at the forum queries address has been telling me that theyve issued a cheque last week (2 different stories from 2 people), and i still haven't got it, its time to start court proceedings as they haven't responded to the LBA that I sent via fax (thanks for the fax number) and post, and hasn't speeded them up anymore. After speaking to an a bloke in India yesterday i'm still no nearer to payment 88 days after the advise that cashback was accepted and payment was going to be made. After reading the post a couple before this it sounds best to try and wrangle the 2nd 3rd 4th and 5th installments out of them too, is this right as i've not even sent the claim off for the 4th one yet , altho that will be in about a weeks time !! Also please can anyone tell me where is the best place to go to start , and how much its going to set me back, as i've never tried this before !! Got the LBA sample of a previous post.

    The best place to start (after reading this thread) is the guide for claimants:

    The fees are a sliding scale, based on the amount you claim. (eg £35 to issue a summons up to £500, plus £50 if a hearing is necessary)

    You can send docs to either the address you have been dealing with, or the registered office (Brander Close).

    If the docs are in connection with your county court case, then you can use the address you have used for the issuing of the summons.

  • I'm due in court in the new year with TMO. They claimed halfway through the contract that I hadn't sent back some of the invoices even though I did and in my covering letter I expressly stated that they were included. They do not argue that they didn't receive the claim, just that it wasn't complete.

    Of course it is my word against theirs!

    I intend to show the judge that I'm meticulous about claiming and keep copies of everything that I sent including the claims prior to them claiming that I'd failed to meet the T&C's. I will present this as evidence.

    Any other advice on how to conduct my case would be appreciated. For example, can I present as evidence some relevant postings to this forum from other TMO customers who they have tried to cheat?

    I signed up to a mobile 'phone contract with a rather convoluted (but perfectly achievable) set of cashback criteria. I diarised all the stages and duly sent in my first 4 statements and welcome note when the first date arrived. Shortly afterwards I got a letter saying my cashback wouldn't be paid out because I hadn't included my welcome note in the paperwork I sent in. Basically they've shafted me because, although I can prove postage (I sent it recorded delivery) I cannot prove what was in the letter. Have I got any comeback, or am I well and truly screwed? I'm not happy :-(
  • I suggest you look up the relevant thread for the dealer on here. This is quite common nowadays and there is a mine of information on the main culprits on these threads.

    Small claims court is your next action. Retailer may just pay up, even if they don't, the arbritrator/judge usually takes a dim view of these conditions because it is almost impossible for you to prove that the letter was included.

    Obviously photocopies of all documents sent do give a bit of defence.
