Problems with CapQuest Debt Recovery Ltd

:mad: Okay I am still not having much luck with CapQuest/Hellix.
I posted that letter as I said and yet the post didn't arrive.
Phoned up the post office and they do not understand why it hasn't been signed for....there investigating for me.
But now the cheeky so and so's send me a letter about doorstep recovery.
I have finished my ivestigation with the catalgue involved and as I said the account is 13 years old and closed, with no debt company working for them....so I cannot understand why this company is trying to get money.
I will be sending another letter, but I am really fed up with these people....they seem persistant about a debt that no longer is being collected for.....13 years old and with no company seeking the payment....things don't make sense in why Hellix/Capquest are trying to claim the money.
Do I continue with the letters and do I refuse to allow anyone access to my home....as I really do not want them at my home for someone elses debt.
Please help this is getting weird for us, thanks to anyone to help me out.

My partner got threatened by them recently exactly how you did for empire catalogue for £236, got threatened with them breaking into house in end! we got App on phone which records calls which we advised them of, also sent the copy of the letter that says "i do not acknowledge your debt" which quotes bits out of the limitation act and justice...havent heard form them for a week now, but i will be notfying the Credit services association and Financial Ombudsman and Office of fair trading..the more people who complain the less likely they are to get away with threatening people, it is illegal to try to retrieve monies with malice. Commonlaw prevails over corporeate law. Debt collectors have no right to force way into home or threaten you for a debt which is over 6 years old (it is statute barred), bailiffs also need court orders/permission to enter your property...hope this helps anyone else too!!! I'm not letting them get away with threatening us...imagine the vulnerable people they are threatening who ARE paying...villains!0 -
Who else is having problems with the naughty naughty unscrupulous debt collectors Hellix Ltd of Richmond? My partner was, until we sent them the letter (downloadable on here somehwhere) stating that the debt is not acknowledged and quoted bits out of the Limitation act stating that a debt (a simple contract debt like a catalogue) which is over 6 years old with NO evidence of contact from the debtors (you) is statute barred and they need the courts permission to continue trying to retrieve the money. BUT you have to state this to them in writing, otherwise if you acknowledge the debt in anyway you may inadvertently renew the contract. It is also against the justice act to harrass people for money once its been declared statute barred. record their calls. Do not plead with them ,tell them to expect a letter and not to conatct you again. Do not reply to their questions (this is how they try and trap you), do not agree to a home visit, debt collectors have a guide to how they are expected to act on the office of fair trading website and government websites. Hellix Ltd staff did not behave this way on the phone and directly contravened the justice act. Even bailiffs need court permission to force entry to your home (and this is usually only in council tax debt cases). And then they can only 'cost' your property, they cant just start taking things away. Its ludricous to entertain the thought that they can! Its breaking, entering and burglary without courts permission or with out notifying you in writing. COMPLAIN!! To the companies in question, or directly to the Financial Ombudsman, Office of fair trading (OFT) or credit services association (these companies often put the CSA accredited thingy at the bottom of their letters to make them look better). DO not acknowledge the debt. We almost did but managed to determine my partner had moved out of the property 2 years previously to when the debt accrued! So its either fraudulent behaviour of tenants after that or Hellix ltd checking previous names and trying their luck they even claimed to have my partners signature on the collection from the empire catalogue delivery people! Thats 7 years ago...obviously this flimsy evidence never materialised even though we requested it. They threatened to break into our home to take goods and unfortunatley for them we have that phone call recorded. A whole week of stress for nothing...they cant get away with it, but there must be people paying and responding to thses heavy handed tactics otherwise they wouldnt bother would they? Imagine a vulnerable old lady being threatend this way in the phone. DISGUSTING!0

I am being phoned at least 3 times a day by Capquest saying I am in debt with t mobile but won't give me with any info unless I confirm my personal details to them. I am not willing to do this as they obviously don't have my address as I haven't received any letters from them even tho they say they've sent a few. I am currently with t mobile but I am not in arrears as I pay my bills monthly. I have told Capquest I will continue to ignore their calls until I receive something in writing and if they have my address this shouldn't be a problem. The horrible advisor just said we will continue to pursue you until you give us your personal details!!! How can I stop this harassment, I don't want to change my mobile number but will have to if it continues. I have spoken to t mobile and they have advised me to speak to their Capquest team, they have a team dedicated to this company so now I don't know if I should trust t mobile!!!
Write to capquest and T mobile (recorded delivery)explaining you do not acknowledge the debt (theres a link on here somewhere for a brillaint letter). they need to provide evidence and if they continue to harrass you you will complain directly to the financial ombudsman and office of fair trading. Otherwise chnge your sim card. If they want to persue you for a debt they must write to you first (is it over 6 year old debt?if so its statute barred..research on the internt!), phoning you 3 times a day is harrassment under the Justice act especially if you have asked them not to...read up on government websites about how debt collectors are expected to behave,,,get an app on yer phone to record their calls and advise them of this. LOG EVERYTHINg and dont give into their harrassment if you believe you dont owe any moneies (it is illegal to obtain money with malice). Alot of people pay up to get them off their backs which is why they do it! It works!! Disgusting.0 -
Hi,I am new on here and have just got a letter from Capquest stating I owe over 300 to them for a Littlewoods account.
I have just called them as I didnt know anything about this account.
They have told me that it is from over 15 years ago from an old address which I did live at .
I told them I did not open such an account and she said I would have to write in to them in the next 14 days .
I also had to give them my date of birth which I was not happy about but she insisted.
Can anyone advise me what to do next.

Hi Savy sorry have been busy so I didn't see your post.
As for the Hellix problem I am feeling a little annoyed with them as we posted a recorded delivery letter to them. Postman claimed it was delievered and yet when I checked the online status thay claim to have not had a signature for it. But they haven't sent another letter to me as of yet....touch wood.
But I have confirmed evidence from catalogue that this account is 13 years old and not open....even told me that there is no debit company working for them in collecting any money as they claim the account is closed.
So I am still going to send another letter to them....by normal post this time....and I will keep on at them....even if they pretend to not take my mail. I know it's going there and the postman said it was taken in.
So I am still fighting this one.....hope you get some light in your situation0 -

Have you got that threat recorded? I'd take that to the police never mind the OFT. These scumbags need to be taught a bloody lesson.0 -
We had a new phone with t-mobile and whilst applying for jobs I took the phone abroad, it kept updating whilst locked in the safe - we didn't know the wifi had been set up, when we got back we had £1000 bill, after a lot of talking to T-Mobile and various organisations they found in their favour, in the meantime the debt was handed over to Cap Quest. The account is in my partners name but I pay every month by calling. Every month the figure is different with new charges being added - they say by t-mobile. T-mobile have said they charged us for line rental when they shouldn't have and have told Cap Quest to remove it but they cant do anything about searcher fees. I have only been paying this for 4 months and in that time have received 2 solicitors letters, been given at least 8 different amounts (taking into account what I have paid), they have advised me over the phone that the agreement has been cancelled twice and today I was asked what my relationship was with account holder. My questions are
1) can they keep adding charges
2) if t-mobile are advising them they have charged us wrong for a few months and they have added seachers fees can I ask them to remove them from the total
3) how many seachers fees can the add
4) why wont they give me a statement without me writting to request one
5) do I have to advise them of my relationship

Okay so an update from me on my annoying Hellix Limited problem.
After several letters to said company they have refused to answer me in any way, no letters, no phone calls.....and no more demands for me to pay.
I would like to think this is the end for me...but I will wait to see what they may do. In saying this....if they refused all the letters I sent to them....does it show me as a complanant that I was right and they were scamming.
Hopefully they will vanish away soon...and take there scam account with them.
Just want to thank everyone on here who helped me out....thanks to you I have finally found my peace, in taking control and fighting back these bullies I found my peace of mind.
